Electoral Crimes/ The General Prosecutor's Office takes stock: 107 criminal

The prosecutors' offices at the first instance court with general jurisdiction, until 22.05.2025, regarding criminal offenses in the field of elections, have reported as follows:

• A total of 107 criminal reports have been registered for criminal offenses provided for by articles 325, 326/a, 327, 328, 328/a, 328/b, 329, 329/a, 331/a and 332/a of the Criminal Code.

• The source of notification of criminal offenses for the above reports were the judicial police in 64 cases, SPAK in 17 cases, political entities in 9 cases, mainly in 11 cases and citizens in 6 cases.

• The above reports were registered 10 in the Fier Prosecution Office, 5 in the Saranda Prosecution Office, 4 in the Durrës Prosecution Office, 33 in the Tirana Prosecution Office, 3 in the Gjirokastër Prosecution Office, 4 in the Kukës Prosecution Office, 8 in the Lezha Prosecution Office, 17 in the Dibër Prosecution Office, 2 in the Vlora Prosecution Office, 4 in the Korçë Prosecution Office, 3 in the Shkodër Prosecution Office, 12 in the Elbasan Prosecution Office and 2 in the Berat Prosecution Office.

• From the above reports, a total of 47 criminal proceedings have been registered for the criminal offenses provided for in Articles 325, 326/a, 327, 328/a, 328/b, 329, 329/a, 331/a and 332/a of the Criminal Code.

• Criminal proceedings have been registered at the Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier, a total of 7 proceedings, 2 proceedings for the criminal offense provided for by Article 325 of the Criminal Code, 1 proceeding for Article 328/a of the Criminal Code, 1 proceeding for Article 328/a, paragraph 4 of the Criminal Code and 1 proceeding for the criminal offense provided for by Article 328 of the Criminal Code.

In the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Gjirokastër, a total of 3 proceedings for criminal offenses provided for by articles 326/1 and 329/1 of the Criminal Code. In the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Elbasan, a total of 9 proceedings for criminal offenses provided for by articles 328/a, 248, 332/a, 134/1 and 287/b of the Criminal Code.

In the Prosecutor's Office at the Court of First Instance of General Jurisdiction of Durres, a total of 1 proceeding for criminal offenses provided for by articles 328/a and 248 of the Criminal Code. In the Prosecutor's Office at the Court of First Instance of General Jurisdiction of Dibër, a total of 7 proceedings for criminal offenses provided for by articles 237/5 and 328/a, paragraph 4 of the Criminal Code.

In the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Shkodra, there are a total of 2 proceedings for criminal offenses provided for by articles 328/a and 328/b of the Criminal Code.

In the Prosecutor's Office at the First Instance Court of General Jurisdiction in Saranda, there are a total of 2 proceedings for criminal offenses provided for by articles 325 and 326/a of the Criminal Code.

In the Prosecutor's Office at the First Instance Court of General Jurisdiction of Kukës, there is a total of 1 proceeding for the criminal offense provided for by Article 328/ai of the Criminal Code.

In the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Korça, there are a total of 2 proceedings for criminal offenses provided for by articles 328/a, 329/2, 237, 89 and 25 of the Criminal Code.

In the Prosecutor's Office at the First Instance Court of General Jurisdiction in Vlora, there is a total of 1 proceeding for the criminal offense provided for in Article 328/ai of the Criminal Code.

In the Prosecutor's Office at the First Instance Court of General Jurisdiction in Lezha, there are a total of 3 proceedings for criminal offenses provided for by articles 327 and 329 and 278 of the Criminal Code.

At the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Tirana, a total of 9 proceedings for criminal offenses provided for by articles 325, 327/1, 328/a, 329 of the Criminal Code.

• 6 criminal reports from the Durrës, Lezha, Dibër Prosecutor's Office and two criminal proceedings from the Fier and Shkodër Prosecutor's Office have been sent to SPAK for its jurisdiction.

• Of the registered criminal reports, a decision was made not to initiate proceedings for 16 of them. 8 from the Tirana Prosecutor's Office, 2 from the Kukës Prosecutor's Office, 3 from the Dibër Prosecutor's Office, 1 from the Saranda Prosecutor's Office, 1 from the Fier Prosecutor's Office and 1 from the Elbasan Prosecutor's Office.

• A criminal proceeding registered by the Dibër Prosecution Office for the criminal offense provided for in Article 237/5, 328/a, paragraph 4, has been requested to be sent for trial with a defendant, without a personal security measure, and a criminal proceeding registered by the Gjirokastër Prosecution Office for the criminal offense provided for in Article 326/1 of the Criminal Code, has been sent to the court with a request for dismissal.

Also, for a registered proceeding for the offense provided for in Article 327/1 of the Criminal Code, at the Gjirokastra Prosecutor's Office, a direct trial has been requested in court.

• 7 people were arrested in flagrante delicto for criminal offenses in the field of elections, 4 in the Tirana Prosecution Office, 1 in the Elbasan Prosecution Office, 1 in the Lezha Prosecution Office and 1 in the Fier Prosecution Office.

• A detention order has been issued for 4 people by the Elbasan Prosecutor's Office.

• Other reports are in the verification phase. / CNA
