General Prosecutor Olsian Çela, while reporting to the High Council of Prosecutions, said that during 2023, 7,254 defendants were convicted, which compared to 2022 represents a decrease of 31.22%.
He emphasized that there is generally a decreasing trend in the number of registered proceedings.
Olsian Çela's words:
During the year 2023, 55253[1] incriminating materials were handled in the prosecution body, which is a decrease of 9.4% compared to 2022. A total of 45715 criminal proceedings were followed, which is a decrease of 5.2% compared to in 2022, of which 24,095 are registered criminal proceedings, with a decrease of 6.2% compared to 2022, and 201 resumed criminal proceedings, which shows a decrease of 70% compared to 2022. 21,011 criminal proceedings were carried out with a decrease of 3.9% compared to the proceedings carried out in 2022. It was decided not to start for 9946 referrals and criminal reports, which means a decrease of 22.2% compared to 2022.
This figure of treated materials includes: the procedures carried out; new proceedings registered during 2023 for the criminal offenses provided for in the Criminal Code; proceedings resumed during 2023; as well as non-starting decisions taken during 2023 without proceedings registered under the military penal code.
During the year 2023, 23419 cases were completed, which is a decrease of 9.41% of completed cases compared to 2022, of which: 41.21% were sent for trial, 25.76% were dismissed, 30.04% were suspended and 2.99% were transferred to competent prosecutors.
9652 cases with charges against 11401 defendants were sent to court. Compared to 2022, there is a decrease of 12.13% in the number of cases sent to court and 11.87% in the number of defendants sent to court. The ratio between cases sent to the court and dismissed cases is 61.54% to 38.46%.
In relation to court decisions, statistical data shows that in 2023, 7,254 defendants were convicted, which compared to 2022 represents a 31.22% decrease in the number of convicted defendants, and for 199 defendants, a decision was made to declare innocent or for 2.67 %.
As presented above, it is evident that there is generally a tendency to decrease the number of registered proceedings. We estimate that the Memorandum of Cooperation with the State Police and the instruction on the implementation of Article 59 of the Code of Criminal Procedure and the handling of other referrals that obviously do not contain elements of any criminal offense, based on which for in 2023, 4588 materials result.
These by-laws, as well as the new procedural institutes, the criminal order and the plea agreement, are intended to help prosecutors to reduce the unnecessary burden and enable speedy legal resolution of lower-risk cases. However, these institutes, as can be seen from the figures above, do not result in giving the right impact./CNA
