Most of the Chambers and business associations, mainly those representing foreign businesses, have escalated their complaints and reaction to the government for the draft law "On the National Chamber of Commerce", which provides for the mandatory membership of all businesses in a National Chamber of Commerce .
In a recent letter addressed to Prime Minister Edi Rama, 17 chambers and business associations, most of which represent foreign investors, have expressed their concern that the draft law has been published for public consultation, without considering their previous comments. Earlier, the business associations addressed a letter to the Minister of State for Enterprise Protection, Delina Ibrahimaj, objecting to compulsory membership in a national economic chamber.
The Chambers of Commerce and Associations, in the last letter, affirm that after the joint letter of the business associations, which was sent on April 11, 2024, to the Minister of Entrepreneurship and Business Climate, they note with great concern that the Draft Law has been published for public consultation , without considering their main comments and concerns.
For the first time, business chambers and associations have addressed their concerns to international institutions and foreign embassies, such as the Delegation of the European Union to Albania, the American and Italian embassies of the United Kingdom, Germany, Austria, Turkey and Greece.
"The way this draft law is being processed for consultation, leads us to think that we are facing a pre-approved model and expresses disrespect for the opinion of the business community, which is directly affected by the draft law.
We are convinced that only the dialogue between the state institutions and the business community, the fair and balanced addressing of the respective problems and concerns of the parties, should serve as a premise for the drafting of the legal and regulatory framework, so that it can be implemented efficiently" , it is said in the last letter addressed to Prime Minister Rama.
Chambers and Business Associations affirm that they appreciate the efforts of the Government for structuring the representation of entrepreneurship through the Draft Law "On the National Chamber of Commerce".
"Also, we have expressed our positive will to participate in the discussion of the Draft Law, by participating in several meetings with representatives of the Ministry of Entrepreneurship and Business Climate.

Në fund të letrës, dhomat dhe shoqatat kanë kërkuar një takim me kryeministrin për të shprehur shqetësimet e tyre dhe për të diskutuar mbi modelin e duhur të organizimit dhe përfaqësimit të biznesit në vend.
Kundërshtimet në procesin e konsultimit publik
Më herët, Dhomat dhe shoqatat kryesore të përfaqësimit të biznesit në Shqipëri shprehën kundërshtimin e tyre dhe në procesin e konsultimit publik.

Sipas Dhomës Amerikane, ky nen sanksionon lirinë e organizimit e cilido personi që të zgjedhë mënyrën e organizimit kolektiv, të cilët nuk mund të detyrohen te marrin pjesë në organizime kundër vullnetit të tyre.

Edhe i ngarkuari në Detyrë i Ambasadës Amerikane në Shqipëri, z. David Wisner gjatë një podcasti për “Monitor”, ku ishte i pranishëm dhe kreu i Dhomës Amerikane të Tregtisë, z. Grant Van Cleve dha mesazhin se dhomat duhet të jenë të pavarura.
“Ne besojmë me vendosmëri se Dhoma është një zë kyç për sektorin privat. Dhe, sa më shumë që Dhomat mund të jenë të lira për të bërë llojin e punës që bëjnë, përkrahja për bizneset, për rritjen e vërtetë të sektorit privat, organik dhe të pavarur është tërësisht kritike. Ky është qartësisht roli që luan Dhoma Amerikane, por unë do të thosha se kjo gjë është edhe më e gjerë se kaq. E di që kjo përfshin edhe Dhomat e tjera që janë të pranishme këtu”. Ka pohuar ai.
Drafti që ka ngjallur shumë diskutime
Projektligji “Për Dhomën Ekonomike Kombëtare” synon një model të ri të përfaqësimit të sipërmarrjes, përmes së cilit praktikisht qeveria do të “monopolizojë” përfaqësimin e sipërmarrjeve në Dhoma e Shoqata biznesi.
The essence of this model includes the reorganization of the current model towards the pure model of public law, respecting the principles of a unified system, with a sectoral approach and regional division. The reform envisages the strengthening of the position of the Public Chamber and the creation of the Unique National Economic Chamber. Membership of commercial entities will be mandatory in accordance with constitutional norms and international models.
Quotation will be scaled based on type and annual turnover, with a symbolic minimum quota for small businesses, with sectorial and regional representation.
This model, according to the report, would foster a unified business voice and promote a regular dialogue with state bodies for business promotion and development.
The report calls the high number of business organizations problematic, with more than 180 associations. According to the report, there is an irregular level of sectoral representation, regional and international representation, as well as there is poor accountability and transparency of the chambers' activity and a lack of cohesion and partnership with the bilateral Chambers.
The role of creating this new model has been left to the Minister for Entrepreneurship, who will set up a temporary Commission with the objective of setting up the new chamber system and organizing the first elections of the governing and decision-making bodies within two years from the entry into force of law. /Monitor
