The Competition Commission, in its meeting on 24.03.2023, considered the issue "On the legal assessment of Agreement Act no. 2729 prot., dated 13.02.2023, between the General Directorate of Road Transport Services, the "National Association of Driving Schools", the Association of Driving Schools "Road Safety" and the General Directorate of Taxes, which has as its object facto and de jure the determination of the payment fee and the minimum fiscal reference cost for preparation and equipment with a driving license, according to the category of driving license, evidence or certificate.

Në përfundim të vlerësimit ligjor, u konstatua se Akt Marrëveshja nr.2729 prot., datë 13.02.2023, lidhur ndërmjet grupeve të interesit përfaqësues të Autoshkollave, DPSHTRR-së dhe DPT-së, është një marrëveshje e ndaluar në vetvete për nga objekti, në kuptim të nenit 4, pika 1, gërma a), të ligjit nr. 9121/2003, pasi me hyrjen në fuqi do të çojë në praktika të njëjta në çmimet/tarifat e pagesës për përgatitjen dhe fitimin e kategorisë së leje drejtimit, dëshmisë ose certifikatës, duke penguar, kufizuar dhe shtrembëruar konkurrencën në treg. Si e tillë kjo Akt Marrëveshje, në kuptim të nenit 4, pika 2, të ligjit nr. 9121/2003, është e ndaluar.

Sa më sipër, Komisioni i Konkurrencës, me vendimin nr. 970, datë 24.03.2023 vendosi:

I. Act Agreement no. 2729 prot., dated 13.02.2023, signed between the parties: the General Directorate of Road Transport Services, the "National Driving School Association", the "Road Safety" Driving School Association and the General Directorate of Taxes, is considered an agreement act contrary to Article 4 of Law 9121.2003, "On the Protection of Competition".

II. Monitoring the market of the preparation service and equipment with a driving license, according to the category of driving license, evidence or certificate, for a period of 1 (one) year.

III. The non-implementation of this decision constitutes a serious violation of competition in the sense of article 74, point 1, letter c), of law no. 9121/2003.
