The incinerator affair is one of the biggest corrupt affairs, which is called the affair of the century.

Finally, SPAK is conducting investigations regarding the affair of the Tirana incinerator, which after the seizure is under the administration of the state.

The former member of the DP National Council, Edvin Kulluri, has reacted regarding the latest developments and the details that have come out regarding this affair.

Kulluri emphasizes that SPAK cannot leave the municipalities out of the investigation.

He says that the financing was done with the help of the Conditional Grant from the Ministry of Finance, but the Municipality of Tirana collects the cleaning fee from the citizens for the service of collection and processing of Urban Waste.

He emphasizes that Tirana Municipality is the owner of the landfill of Tirana where the incinerator is located or should have been located and is responsible for the administration of the service.

So, not only as an institution legally responsible for the service, but it has legal responsibility for taking over the incinerator.

The municipality of Tirana has direct responsibility for the implementation of the contract with the company, which means that it should oversee the service provided that was never provided.

In conclusion, says Kulluri, these findings apply to all 5 municipalities in which the treatment of Urban Waste through burning, i.e. incinerators, has been implemented, which in fact did not happen and is therefore being investigated by SPAK.

The municipalities of Tirana, Elbasan, Fier, Kavajë and Vorë have full responsibility in the incinerator scandal.

" Since there has been a discussion for days whether Erjon Veliaj risks being taken as a defendant for the Incinerator of Tirana, a few words should be said about the legal aspects that arise after the seizure by SPAK of the Incinerator!

1) The treatment of Urban Waste is the legal competence of the Local Government, although the scheme was built by the Council of Ministers. Regardless of the adopted VKM, the Municipalities are run by a Mayor directly elected by the citizens.

2) Indeed, the financing was done with the help of the Conditional Grant from the Ministry of Finance, but the Municipality of Tirana collects the Cleaning Fee from the citizens for the service of collecting and processing Urban Waste.

3) The company that falsified the invoices according to SPAK, delivered them to the Municipality of Tirana and then they were passed on to the Directorate of the Tirana Treasury.

4) The Municipality of Tirana is the owner of the landfield of Tirana where the incinerator is located or should have been located and is responsible for the administration of the service. So not only as an institution legally responsible for the service, but it has legal responsibility for taking over the Incinerator.

5) The Municipality of Tirana has the direct responsibility for the implementation of the contract related to the company, which means that it must supervise the service provided that was never provided.

6) Te gjitha keto pergjegjesi nuk mund ti lihen Keshillit Bashkiak te Tiranes per sa kohe Keshillat Bashkiake nuk kane pergjegjesi ekzekutive sipas Ligjit Per Organizimin dhe Funksionimin e Qeverisjes Vendore. Kjo eshte si te thuash qe Kuvendi i Republikes se Shqiperise ka pergjegjesi per ligjshmerine dhe funksionimin e Keshillit te Ministrave.

In conclusion, these findings apply to the 5 municipalities in which the treatment of Urban Waste was implemented through burning, i.e. incinerators, which in fact did not happen and for this reason is being investigated by SPAK! Also, with the conviction that as the former Coordinator of the Group of Decentralization Experts in 2001-2002 and the former Secretary General of the Ministry of Defense in 2010-2013, I referred to the laws in force and their spirit, being convinced that the municipalities of Tirana, Elbasan, Fier, Kavaje and Vore have full responsibility in the incinerator scandal!", writes Kulluri./ CNA
