DP: Diella is an extension of Rama, aims to control public funds

The DP's Anti-Corruption Spokesperson, Genta Vangjeli, in a statement to the media, spoke again about AI Minister Diella.

According to Vangjeli, Diella is Rama himself and the reason for this invention is that the prime minister aims to exercise absolute control over public funds.

"The public administration's refusal to implement illegal orders has led to the invention of the 'virtual minister' Diella by Prime Minister Rama."

In the face of constant pressure on public administration employees during the Rama 1, 2 and 3 governments, who have refused to become part of legal violations in public procurement procedures, the Prime Minister has chosen to create a new informal mechanism: the so-called 'virtual minister' Diella.

According to the Prime Minister, Diella will guarantee that public tenders are 100% incorruptible and completely transparent.

But fundamentally, this initiative raises a number of serious legal and constitutional concerns:

The concept of a 'virtual minister' does not exist in any article of the Albanian Constitution or laws. The appointment, swearing-in and dismissal of a minister is clearly regulated by law, and cannot be replaced by a legally unidentified entity.

There is no form of legal or institutional accountability for this 'virtual minister'. Who oversees Diella? Who is responsible in case of legal violations or damage to public finances?

The Public Procurement Law clearly defines the division of roles and responsibilities. From the head of the contracting authority, to the preparation of the limit fund, the drafting of technical specifications, the evaluation of bids and the supervision of the implementation of the contract – every step is regulated and divided between different actors, precisely to avoid the concentration of power and abuses.

Prime Minister Rama has unprecedentedly concentrated all functions of the procurement system in a single hand, that of Diella, who is in fact an extension of the Prime Minister himself.

This is the core of the problem with corruption in tenders: not the electronic procurement system, which is secure, nor the existing legislation, but the continuous interventions to declare predetermined operators winners, in violation of the legal criteria of the competition.

The decree of the President of the Republic officially confirmed the Prime Minister's involvement in the establishment and management of this informal structure, through which he aims to exercise absolute control over public funds.

 'Virtual Minister Diella', or in other words, Edi Rama himself, does not meet the legal criteria for efficient, effective and economic administration of public resources.

"This mechanism does not guarantee transparency, legality, or protection against misuse and theft of public property; on the contrary, it paves the way for abuse without any accountability," said Vangjeli./ CNA
