Threats due to duty/Definition of protection conditions for employees of the

A Decision of the Council of Ministers, dated 7 May 2025, has determined the conditions for special protection of employees of the Police Supervision Agency. The Decision refers to situations when their life, family and property are threatened due to their duty.

The 15-point VKM provides details of the procedure for the conditions and manner of protection in support of Article 100 of the Constitution and point 2, Article 75, of Law No. 128/2021, "On the Police Supervision Agency".

DECISION

ABOUT 

DETERMINING THE CONDITIONS AND METHOD FOR THE SPECIAL PROTECTION OF THE EMPLOYEE OF THE POLICE SUPERVISION AGENCY, WHOSE LIFE, FAMILY AND PROPERTY ARE THREATENED DUE TO THEIR DUTY

In accordance with Article 100 of the Constitution and point 2, Article 75, of Law No. 128/2021, “On the Police Supervision Agency”, upon the proposal of the Minister of Interior, the Council of Ministers

DECIDED:

1. An employee of the Police Supervision Agency (hereinafter referred to as AMP), whose life, family and property are threatened by illegal actions of third parties during or because of the exercise of his/her function, shall be provided with special protection.

2. Special protection means measures of an organizational and professional nature for the special protection and preservation of the life, family and property of the threatened AMP employee, as well as any other measure related to this protection.

3. The threatened AMP employee benefits from special protection if the following conditions are met:

a) The presence of serious circumstances that endanger the life, family or property of the AMP employee;

b) The condition of the AMP employee in a situation that requires immediate action or measures to resolve it, as well as to avoid any possible harm;

c) The presence of a causal link between the serious circumstances and the risk of harm to the lawful exercise of the duty.

4. The methods of special protection consist of:

a) physical protection or escort of the endangered AMP employee;

b) physical protection or accompaniment of at-risk family members of AMP employees;

c) safeguarding the property of the endangered AMP employee.

5. Special protection for the threatened AMP employee is provided by decision of the Threat Assessment Committee (TAC), which is established and operates at the General Directorate of the Police Supervision Agency.

6. The Threat Assessment Committee consists of:

a) Deputy Director General, chairman;

b) Director of Investigation, member;

c) Director of the Special Operations Force, member;

ç) Head of the analysis and information sector, member;

d) The regional director of the district where the threatened person resides, member.

7. A written request for special protection of a threatened AMP employee is submitted to the Threat Assessment Committee by:

a) an employee of the AMP, whose life, family and property are threatened;

b) AMP structures that become aware of the presence of serious circumstances that endanger the life, family and property of the AMP employee;

c) any other public body that, due to its function, becomes aware of the presence of serious circumstances that endanger the life, family and property of the AMP employee.

8. The request for special protection shall contain:

a) the full particulars of the threatened AMP employee;

b) a summary of the facts and circumstances that constitute a serious risk to the AMP employee, which oblige him to seek special protection, as well as the source of evidence on which they are based.

9. The Threat Assessment Commission, within 10 (ten) days from the submission of the request for special protection, decides:

a) acceptance of the request, also determining the concrete protection measures;

b) rejection of the request.

10. The decision of the Threat Assessment Commission is approved by the Director General of the Police Supervision Agency and contains:

a) the introductory part, which reflects the subject that made the request, the time and place of the decision, as well as the nominal composition of the commission;

b) the descriptive part, which provides the circumstances that prompted the subject to make the request, the criminal offense committed, the personality of the threatened person, the social danger of the threats and assessments of the data possessed about such a fact;

c) the decision-making part, which determines the concrete measures for special protection, the time, the executor of the decision, the term for the extension of the measures, the expenses and the entity that will bear these expenses.

11. The decision of the Threat Assessment Commission to provide special protection shall determine the methods of protection and its duration.

12. In addition to taking protective measures, the Police Supervision Agency cooperates with other institutions to continuously obtain information, in order to prevent possible criminal events towards the AMP employee under protection, his family and property.

13. In cases where the threatened AMP employee performs his duty away from his residence and family, urgent protective measures are taken as needed for him and his family, in order to protect him and his family, depending on the intensity of the threat.

14. In the event of a serious and immediate danger, the Director General of the Police Supervision Agency orders the relevant structures in the AMP to take immediate measures to guarantee the safety of the life, family and property of the threatened AMP employee. The KVK, within 10 (ten) days, evaluates the measures taken by the structures of the Police Supervision Agency and decides on their continuation or not.

15. The Ministry of Interior and the General Directorate of the Police Supervision Agency are responsible for the implementation of this decision.
