On Monday, September 18, the elected mayor of Himara, Fredi Beleri, is expected to have his next appearance in Apel, to request his release from prison.

Beler's request to be released from custody was rejected 5 times.

Specifically, the request was dismissed once by the Court of Vlora, twice by the Special Court of First Instance, once by the Court of Appeal and once by the Supreme Court.

All levels of judgment have assessed that suspicions of corruption in elections are reasonable and based on evidence.

In the argument of the Special Court, it is stated that the elected mayor of Himara can leave the country.

"The court has reasoned that due to the personality of the person under investigation, Dhionisios Alfred Beleri, given that he has been convicted before, there is a real risk that he will commit more serious or equally serious criminal offenses... due to the criminal offense of which is suspected, the margin of punishment and the stay of the person under investigation, there is a real risk that he will leave, making the normal development of the investigation impossible... due to the position of the person under investigation, there is a risk that he will influence the taking or the authenticity of the evidence", declares GJKKO.

The Court of Appeal uses the reasoning that it can hinder the investigation or even spoil the evidence.

"The court also takes into account the fact referred by the prosecution in the hearing in the appeal trial that in the minutes of the environmental inspection, from the examination of the photos of the premises of the bar where the meetings between Mr. Dhionisios Alfred Beleri and Mr. Arsen Rama and Mr. Pandeli took place Kokaveshi and Mr. Arsen Rama, it is understood that the bar has security cameras and that although this fact has turned out to be so even within the premises of this bar, it has not been possible until now to seize the recording equipment of the bar's cameras".

Meanwhile, the Supreme Court mentions the 3-year prison sentence of 2006 and the fact that he never went to jail, as he avoided criminal proceedings.

"He avoided the criminal punishment assigned to him previously by the courts for the criminal offenses for which he was convicted of "calling for national hatred" and "humiliation of the Republic and its symbols", which shows that the person under investigation, Beleri, has a tendency and presents a risk not only to leave, but also to commit serious crimes, or of the same type, as the one for which he is being prosecuted."

In his confrontations with the court, the elected mayor of Himara has denied the charges against him, claiming that they are politically motivated.

However, all levels of the judiciary consider it safer to continue the investigations with Fredi Beleri in the cell./ CNA
