Adriana Kalaja has announced that tomorrow she will file a criminal complaint against the Minister of the Interior, Ervin Hoxha, Ilir Proda, Director General of the State Police, Elton Alushi, Head of the Local Directorate of the Tirana Police, Robert Losha, Head of Commissariat No. 1 Tirana and any police officer of this commissariat or unidentified.

Based on her post on "Facebook", Adriana Kalaja has announced that this criminal complaint comes after these responsible persons have committed the criminal offenses of "Abuse of duty", "Obstruction in the exercise of the right to assembly", and "Arbitrary actions". regarding not taking measures to guarantee the conditions for the development of the protest in front of the Tirana Municipality.

NOTICE:

Dear Centrists, Democrats, Friends and Supporters of the Alliance for the Protection of the Theater,

I inform you that tomorrow, 23.12.2024, at 11:00 a.m., as a lawyer and activist of the Alliance for the Protection of the Theater as well as the Chairperson of the Appeal and Evaluation Committee of the Statute of the Democratic Party (DPA Court), I will file a criminal complaint against:

1. Ervin Hoxha, Minister of the Interior;

2. Ilir Proda, General Director of the State Police;

3. Elton Alushi, Head of the Tirana Local Police Directorate.

4. Robert Losha, Head of Commissariat No. 1 Tirana;

5. Any police officer of this commissariat or unidentified by us, who have committed the criminal offenses of "Abuse of duty", "Obstruction in the exercise of the right of assembly", and "Arbitrary actions", related to not taking measures to guarantee of the conditions for the development of the protest according to letter No. A- J 97 Prot., dated 19.12.2024, of the Tirana Local Police Directorate.

On this occasion, I inform you that on 18.12.2024, I filed a notice with the Tirana Local Police Directorate, in support and implementation of articles 47 and 48 of the Constitution of the Republic of Albania, article 5 et seq. of Law No. .8773 dated 23.04.2001 "On Gatherings" and Decision No. 24 dated 04.05.2021 of the Constitutional Court of the Republic of Albania, regarding a citizen's meeting to be held on 20.12.2024 with the following data:

The purpose of the civic gathering is:

Citizen reaction to the serious situation created in the Municipality of Tirana, after the arrest and prosecution of many leaders of this municipality, for the accusations raised by SPAK such as corruption, abuse of office, etc.

The urgent resignation of the Mayor Erion Veliaj will be requested as the main responsibility for the situation in which the Municipality of Tirana and the City of Tirana are located today.

Do i bëhet thirrje Prokurorisë së Posaçme SPAK, marrjen e masave të menjëhershme për arrestimin e Erion Veliajt, si një rrezik serioz dhe potencial për prishjen e provave.

Tubimi do të mbahet më datë 20.12.2024, përpara Bashkisë Tiranë me adresë: Bulevardi “Dëshmorët e Kombit”, në orën 10.00 deri 20.00.

Numri i përafërt i personave që do të marin pjesë në tubim do të jetë 200 deri në 350 qytetarë dhe numri i personave ndihmës në mbarëvajtjen e protestës do të jetë 15.

Të pranishëm do te jenë qytetarë të ndryshëm, politikanë, të rinj, artistë dhe sportistë njohur të cilët mund të flasin me mikrofon sipas dëshirës.

Sipas shkresës me Nr. A J 97 Prot., datë 19.12.2024 të Drejtorisë Vendore të Policisë Tiranë, jemi vënë në dijeni të faktit se kjo drejtori e ka marë njoftimin si dhe shprehet se do merte masa për garantimin e zhvillimit normal të tubimit, në zbatim të Ligjit Nr.8773 datë 23.04.2001 “Për Tubimet” në oren 10.00 deri në orën 13.00, duke na kujtuar edhe respektimin e orarit të protestës.

E gjej me vend T'Ju kujtoj se sipas Ligjit Nr.8773 datë 23.04.2001 “Për Tubimet”, në nenin 6 të saj, “Detyrimi i policisë “, ligjvënësi ka sanksionuar se:

“1. Shefi i Komisariatit të Policisë, brenda 24 orëve nga marrja e kërkesës sipas pikës 2 të nenit 5 ose brenda 8 orëve nga marrja e kërkesës sipas pikës 3 të nenit 5 të këtij ligji, me vendim të arsyetuar duhet:

a) t’i komunikojë organizatorit ose drejtuesit të tubimit ndalimet dhe kufizimet e mundshme ose kushtet e tjera, duke përshirë edhe numrin e personave që do të ndihmojnë në mbarëvajtjen e tij;

b) t’u japë një kopje të urdhrit zyrtar për caktimin e oficerit të policisë që do të jetë përgjegjës për të ndihmuar e vëzhguar zhvillimin e tubimit.

2. Shefi i Komisariatit të Policisë njofton me shkrim drejtuesin e pushtetit vendor dhe prefektin për zhvillimin e tubimit.”.

Ndërkohë, situata pranë vendit ku ne kishim njoftuar  mbajtjen e tubimit, ishte kaotike dhe në rrezik të një konflikti me qytetarët, pasi organet e Policisë së Shtetit, "kishin harruar“ të zbatonin diapozitat ligjore në fuqi, dhe vetë detyrimet që lindin nga shkresa e nxjerrë prej tyre.

Në këto kushte, ne me të drejtë ngremë shqetësimet tona legjitime për këtë situatë absurde  që dëmton edhe vetë Policinë e Shtetit.

Po kështu, Ju kujtojmë se asnjë veprim arbitrar i Policisë së Shtetit, kthyer në Policinë e narko pushtetit, nuk na ndal në rrugën tonë legjitime dhe të drejtave tona garantuar nga Kushtetuta.

Në këto kushte, ne kërkojmë fillimin e hetimit penal ndaj të kallëzuarve për të gjithë këtë situatë dhe ku duhet të zgjidhen çështje shumë të rëndësishme si:

1. Të hetohet se cili ka qënë plani i masave marë nga Policia e Shtetit.

2. Të hetohet se cili ka qënë plani i masave marë nga Komisiariati Nr. 1 Tiranë.

3. Të hetohet ajo pjesë e Policisë së Shtetit pranë Komisiariatit Nr.1 që nuk ka marë masa për bllokimin e atij aksi rugor.

4. To investigate that part of the State Police near Commissariat No. 1 that did not guarantee the normal development of the protest.

5. To investigate the entire behavior with actions or inactions of the Minister of the Interior and the entire chain of command in the State Police.

It is clear that the narco-power is in trouble and therefore seeks to create conflicts between the protesters and the police and above all between the protesters and the citizens.

We don't stop.

To the end and to victory.
