The investigations are over/ SPAK takes the file of the former socialist mayor

At the end of the preliminary investigations of criminal proceedings no. 67 of 2023, the Special Prosecutor's Office against Corruption and Organized Crime submitted to the Special Court of First Instance for Corruption and Organized Crime (on 16.08.2023) the request for trial against the defendants:

1. Fran Tuci, accused of the criminal offense of "Abuse of duty", committed in cooperation, provided by article 248 and 25 of the Criminal Code;

2. Ndoc Marku, charged with the criminal offense of "Abuse of duty", carried out in collaboration, provided by article 248 and 25 of the Criminal Code;

3. Durim Margjekaj, accused of the criminal offense of "Illegal construction", provided by article 199/a pgf 4 of the Criminal Code.

From the analysis of the evidence gathered during the preliminary investigation, it turns out that it is proven that the defendants Fran Tuci and Ndoc Marku, in cooperation between them, with illegal actions and omissions which constitute regular non-fulfilment of duty, have brought as a direct consequence serious damage (estimated at ALL 234,007,500) to the property of the "forest fund" type and the corresponding terrain, registered in the cadastral office in the name of Fushë Arrëz Municipality.

While the defendant Durim Margjekaj, in the capacity of the administrator of the company "Legendari" sh.pk, with complete and direct intention, has carried out infrastructure construction works without the relevant permit, bringing serious consequences to the property of the type "forest fund" owned by the municipality. Walnut field.

Clarification: The request for judgment is part of the criminal prosecution exercise. Everyone is presumed innocent until proven guilty by a final decision.
