Judges: AfD's Treuttler has exceeded his authority
The oldest member of parliament, leader of the constituent session of the Thuringian state parliament, Jürgen Treutler of the AfD

After a chaotic session of the state parliament, Thuringia's constitutional judges gave clear instructions for the continuation of the session on Saturday morning.

What did the Constitutional Court decide?

In a ruling on Friday evening, Thuringia's Constitutional Court made it abundantly clear that the chairman of the session, the oldest member of parliament to chair the state's first parliamentary session, Jürgen Treutler of the AfD exceeded his authority in the first session. of the parliament of the land on Thursday and has violated the rights of the deputies several times. He should have decided on the quorum of the parliament in the meeting and then let the MPs vote on the provisional agenda. There are already clear instructions from the judges for the continuation of the session on Saturday morning.

The oldest AfD deputy and head of the session on Thursday, (26.09) Treuttler had taken an opposite position: he was of the opinion that the state parliament could change the regulation only when it was constituted, i.e. a president had been elected. parliament. The Constitutional Court of Thuringia has now clearly said that Treutler is wrong. According to her, the parliament has the right to self-organization that originates from the constitution. The Parliament, i.e. the representatives, can establish its own rules (work regulations). And this is possible at any time, according to the judges: "The Turing Constitution does not regulate the order of individual constitutional acts. In particular, the Constitution does not specify that the election of the President of the Land Parliament must take place before the working regulations are approved."

Chaos in the parliament of Thuringia

The first session of the parliament of Thuringia after several hours of fierce debates on Thursday (26.09.) was interrupted. A routine parliamentary procedure, where the president of the parliament is elected and important posts are filled, turned into a bitter row between the AfD party, declared by the Office for the Protection of the Constitution as "safely far-right", and other parties in the parliament. The session was interrupted without being able to elect the president of the parliament of the land.

As a rule, the largest parliamentary group in the parliament has the right to propose the president of the parliament of the land. In Thuringia this group comes from the AfD, which won the majority of votes in the state elections in early September. The CDU and the Alliance Sahra Wagenknecht, BSW wanted with a request to change the agenda to change the procedure, and thus prevent the AfD from making a bid for the post.
