Indictment against an Albanian suspected of committing crimes with Serbian

The Special Prosecution Office in Kosovo filed an indictment on Wednesday against the defendant MI, of Albanian nationality, on suspicion of having committed the criminal offense of "war crime against the civilian population" in collaboration with members of the Serbian police forces during the recent war in Kosovo.

According to a statement issued by the Prosecution, the defendant is said to have committed the offense for which he is charged - including murder, rape, arrests and mistreatment of the Albanian population - in the period 1998-1999 in the village of Osek Hylë in the Municipality of Gjakova.

The trial is proposed to be held in absentia, as the defendant is at large.

Trial in absentia, according to the justice system in Kosovo, can only take place provided that the prosecution and the court have exhausted all means to ensure the presence of the accused.

On December 26 of last year, the Basic Court in Pristina sentenced Çedomir Aksiq to 15 years in prison, on charges of war crimes against the civilian population, committed from January to May 1999 in the territory of the municipality of Shtime, respectively in the villages of Reçak, Malopolc and Petrovë.

This is the first war crimes verdict made in absentia, based on the amended Criminal Procedure Code of 2022./ CNA
