Last year, 19 subjects were excluded from the right to benefit from public contracts.

The Public Procurement Agency (APP) announced that the main reason for this decision was non-fulfillment of contractual obligations, while in second place was misinformation in the documentation. The agency did not release the names of the excluded companies.

"Regarding the exclusion decisions (19 such), it results that from these: 7 economic operators were excluded from the right to win public contracts due to misinformation and submission of documents in the tender, which contain false data; 1 economic operator in implementation of the decision given by the court; 12 economic operators have been excluded due to non-fulfillment of contractual obligations", states the APP's annual report.

But while the decision was made for this group, for another part it was decided either suspension for the exclusion or non-exclusion.

Thus, according to the report, the decision was made not to exempt 3 economic operators from the right to win public contracts. For four others, a decision was made to suspend the process started for exclusion from the right to win public contracts due to the judicial process, and for four others, the process of administrative proceedings continues.

The number of denunciations or issues raised for the exclusion of operators from public contracts has been higher, but APP has not in all cases deemed it reasonable to initiate administrative proceedings.

"From the 60 requests/information administered, it results that: the administrative procedure has started for 30 economic operators; 29 requests, were incomplete in legal arguments and documentary evidence, or after the performed verifications, it turned out that there were not the conditions provided by the legal provisions for the initiation of administrative proceedings by APP; 1 request is in the review process", the report assesses.

In its explanation, the Public Procurement Agency has underlined that for 30 economic operators, it has not started the administrative procedure, since the request submitted by the proposers (economic operators/contracting authority) was considered with insufficient documentation and not substantiated to start the administrative procedure. or after the performed verifications, it turned out that the conditions for starting the administrative procedure were not met, according to the provisions of Article 78 of the LPP./ Monitor
