Mariglen Qato is one of the directors of Erion Veliaj who was arrested this Thursday, by order of SPAK, in connection with the 5 D file.

Qato is accused of the criminal offenses "Passive corruption of persons exercising public functions", in 4 cases, in cooperation and "Refusal to declare, non-declaration, concealment or false declaration of assets, private interests of elected persons and public servants or of any the other person who has the legal obligation to declare".

But the 5 D file is not the only case when Qato has had to face justice for his exploits.

Previously, for the director of Veliaj, there was an investigation for illegal construction by the Prosecutor's Office of Tirana, related to the time when he was Chief Inspector at the IMT, Municipality of Tirana.

At that time, Mariglen Qato was investigated for the criminal offense "Abuse of duty", committed in cooperation, but the case was dismissed.

In one of the requests of the Prosecutor's Office for a security measure, it is said that Qato had not fulfilled the mission assigned by law for the protection of the territory and the environment and had allowed illegal construction, seriously harming the legitimate interests of the state.

"The Chief Inspector and the inspectors of the IMT, although they became aware of the illegal construction, carried out formal actions, not taking any of the measures provided for in Article 5/b, c, ç, d and dh, of the law with no. no. 9780 dated 16.07.2007 amended "On the Inspection and Protection of the Territory from Illegal Constructions", as well as in article 5/b, c, ç and d of the Internal Regulation of IMT. Although the illegal construction was clear, visible, the Chief/Inspector took light administrative measures in imposing a fine in the amount of 300,000 ALL, and subsequently no procedure was carried out for the execution of this fine, even though it is an executive title. According to Article 4 of the law, the chief inspector and the inspectors are the persons responsible for the control of the territory and the implementation of legality, especially after they have become aware of an illegal construction. The inspector issued the decision to suspend the works, which in this particular case was not necessary since the decision to demolish the illegal construction could be taken directly," the request said.

According to the prosecutor's office, Qato, in his role as chief inspector, with his actions and inactions, in regular failure to fulfill his duties, by not making the right decisions and at the right time, as well as by not ensuring their implementation and control, allowed the construction without leave.

Also, in the request, it was stated that Qato has continuously avoided the investigation and has not appeared at the Prosecutor's Office, claiming his serious health condition.

"Meanwhile, from the surveillance of the security cameras in the premises of the IMT and the Municipal Police, it results that the citizen Mariglen Qato on the dates 07.08 and 09 June 2021 showed up for work, in the premises of the IMT and stayed for several hours, what happened question not only his state of health, but the fact has been proven that this citizen, although dressed in public office, deliberately avoided appearing in the prosecution body and making himself available to the investigation as a whole", it was further underlined .

However, the director of Veliaj escaped from the handcuffs for the illegal construction, as the case was dismissed.

Now, he has been arrested and is being investigated for the file 5 D - 5 Directors, where SPAK states that he is the "de facto" owner./ CNA
