Strasbourg Court's decision revealed: Dismissal of former judge

The European Court of Human Rights (ECHR) has ruled that the dismissal of former Supreme Court judge Shkëlzen Selimi from the vetting process was unfair.

According to the court's decision, the vetting bodies did not respect the minimum standards of transparency, reasoning and the right to a defense, violating Article 6 of the European Convention on Human Rights, which guarantees the right to a fair trial.

Earlier, the GJKKO declared Selim not guilty of the charges brought by SPAK for refusing to declare and concealing assets.

In the decision published by the ECHR, it is noted that the court rejected the rest of Selimi's claim for compensation, but forced the state to pay him 6,500 euros for the costs of the legal process within 3 months.

“The Court unanimously declares admissible the complaints concerning the applicant’s rights to a fair trial and to respect for private life;

- Holds that there has been a violation of Article 6 § 1 of the Convention;

-Decides that there is no need to examine the complaint under Article 8 of the Convention;

Holds that the finding of a violation constitutes in itself sufficient just satisfaction for any non-pecuniary damage suffered by the applicant;

Holds

(a) that the respondent State is to pay the applicant, within three months from the date on which the judgment becomes final in accordance with Article 44 § 2 of the Convention, EUR 6,500 (six thousand five hundred euros), plus any tax that may be chargeable to the applicant, in respect of costs and expenses, to be converted into the currency of the respondent State at the rate applicable at the date of settlement; 

(b) from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amount at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points;
