"Veliaj, Xoxa, Abule as a structured criminal group"/ The Special

In the 114-page Appeals decision of the GJKKO and Judge Engert Pëllumbi dated March 13, it is underlined that the cooperation of the persons under investigation Erion Veliaj, Ajola Xoxa and Elman Abule has the characteristics of a special cooperation, that of a structured criminal group, regulated by Article 2874 of the Criminal Code.

According to the Appeal of the Criminal Court, the criteria of plurality of persons, the commission of criminal activity for the purpose of material gain, and the group not being created by chance (the commission of criminal activity repeatedly and over a long period of time) are met.

The Appeals Decision of the GJKKO emphasizes that "despite the fact that such a form of cooperation has not yet been attributed to these persons in the investigation and, consequently, will not be taken into consideration at this time by the court in determining the type of security measure, as otherwise the principle of non-reformatio in peius of the defendant's position would be violated".

Thus, the Court passes the "ball" to SPAK prosecutors, who have only requested the wiretaps.

Judge Engert Pëllumbi went beyond SPAK, underlining that citizens Erion Veliaj, Ajola Xoxa and Elman Abule have characteristics of a structured criminal group based on all the evidence collected.

The court, with its decision, beyond the interpretations of Erion Veliaj's mercenaries, says one thing very clearly: the ball is in the hands of the prosecutors. It asks that this matter be treated as a matter of a structured criminal group. This is beyond the wiretaps and writings made by Veliaj's soldiers.
