Begtash Zeneli case/ Prosecutor challenges decision of Court of Appeal

The court hearing before the United Colleges continues. The representative of the General Prosecutor's Office, Arqilea Koça, opposes the decision given by the Court of Appeals on "house arrest" in the case of Begtash Zeneli.

Prosecutor Koça defends the appeal made to the High Court after the Court of Appeals granted house arrest to Zenel. 

Initially, the Court of First Instance in Lezha had decided the legal validity of the arrest in flagrante delicto and the imposition of the measure "prison arrest".

But, after the defense appealed, the Court of Appeals changed the decision, assigning the lighter measure of "house arrest".

In response to this decision, the Prosecution filed an appeal with the High Court, stating that the Appeals Court incorrectly applied Articles 229 and 230 of the Criminal Procedure Code, as it did not conduct a full analysis of the circumstances of the case, the seriousness of the criminal offense, and the suspect's profile.

The prosecution argues that, in the specific circumstances, "prison arrest" is the only appropriate measure, taking into account the nature of the offense, the quantity of narcotics seized, the manner in which the case was discovered, and the criminal past of the person under investigation.

Also, the appeal emphasizes that a milder measure such as "house arrest" can only be justified if concrete evidence is presented that significantly reduces the risk posed by the suspect, evidence that, according to the Prosecution, is lacking in this case./ CNA
