Përgjimi i anëtarit të Gjykatës Kushtetuese/ Ish-prokurori: SPAK zbatoi procedurën

Ish-prokurori Eugen Beci i ftuar në “Open”, theksoi se SPAK ka qenë në të drejtë të plotë për të vendosur në përgjim një anëtari të Gjykatës Kushtetuese. Ndër të tjera, Beci shtoi se SPAK nuk ka shkelur kodin e procedurës penale.

“SPAK ka kryer hetim pro aktiv, teksa prokuroria po përpiqet që të ketë prova, nga subjekte që mund të jenë nën hetim nga Prokuroria e Posaçme. SPAK besoj se ka pasur indicie për përgjimet. Nga ana formale, SPAK nuk ka shkelur kodin e procedurës penale. Përgjimet publike bëhen vetëm me miratimin e prokurorit. Në ambiente private, autorizimi mund të merret nga gjykata.

SPAK është në rregull nga pikëpamja proceduriale. Ka informacion se mund të ketë korrupsion për një çështje të caktuar dhe në këto procedura është në rregull. Prokuroria e Posaçme ka zbatuar në mënyrë rigoroze formën sesi nis një procedim. Kemi edhe një super Prokurori, e pabalancuar në atë fuqi që duhet të ketë çdo pushtet në vetvete. Problemi është tek mënyra sesi është ndërtuar legjislacioni dhe reforma”, tha Beci. /CNA
