In the attack against SPAK/ The Constitutional Court does not distance itself

CNA today reported on the attacks and scenarios being made against SPAK by institutions including the Constitutional Court regarding the fact that the vetting within SPAK and the GJKKO is being sought to be overturned.

After the media frenzy about the wiretapping by the Special Prosecution Office, who sold it as if it were a violation, it is actually quite the opposite, as SPAK prosecutors have the right to wiretap to secure evidence and this is not about simple wiretaps, but as we emphasized, it is about the Constitutional Court overturning the SKY and Encrochat files.

The Constitutional Court has reacted to this, stating that it is guided by the principles of collegiality, independence and impartiality, sanctioned in the fundamental law.

The Court has emphasized that, as it has acted so far, it will continue to exercise its powers with correctness, integrity and independence from any external influence or pressure.

Thus, the Constitutional Court has not distanced itself from the media quagmire or the scenarios to attack SPAK.

"The Constitutional Court, given the media debate of recent days regarding the wiretapping of a constitutional judge by the Special Prosecutor's Office, which is related to the exercise of his activity, considers it important to clarify to public opinion that in exercising its constitutional mission to guarantee the supremacy of the Constitution, it is guided by the principles of collegiality, independence and impartiality, sanctioned in the fundamental law.

The Court is aware of the impact that its activities and the strength of its authority have on political and institutional actors, the media, the parties to the proceedings, and public opinion. For these reasons, the Court follows the rules of transparency in decision-making, with the aim of creating and maintaining public trust in it.

The Court has previously expressed its belief that exercising its activity in a climate of trust by everyone serves to strengthen its authority as an independent constitutional body, and has therefore raised concerns about misinterpretations and attempts to involve it in debates disguised as legal discourses in order to prejudice concrete decision-making and interfere with its independence.

Without wishing to become part of any media discourse, the Court would like to emphasize that the decision-making process in exercising the function of delivering constitutional justice is based on the principles and procedures provided for by the constitutional and legal framework, with each decision being the result of a process of discussion of the opinions and positions of each constitutional judge, according to his internal conviction, for which he enjoys immunity guaranteed by the Constitution in the exercise of his function.

"The Court, recognizing the importance of the exercise of the powers of every public body in a state governed by the rule of law in compliance with the constitutional and legal framework, wishes to emphasize that, as it has acted so far, it will continue to exercise its powers with correctness, integrity and independence from any external influence or pressure," the Constitutional Court said./ CNA
