KPA upholds KPK decision/Removes Prosecutor Basha from duty

The Special Appeals Chamber has upheld the decision of the KPC regarding prosecutor Kujtim Basha.

On October 18, 2023, the KPK decided to dismiss Prosecutor Basha from his duties after he resulted in a negative balance of 12 million leis in his asset declaration.

The KPA decision was made by a panel consisting of Rezarta Schuetz as chair, Sokol Çomo as rapporteur, Albana Shtylla, Ina Rama, and Natasha Mulaj as members.

The panel of the Special Appeals Chamber, composed of Rezarta Schuetz as presiding judge, Sokol Çomo as rapporteur, Albana Shtylla, Ina Rama, Natasha Mulaj as members, announced the decision on case no. 57/2023, dated 20.12.2023, which concerns the appeal of the re-evaluation subject Kujtim Bashaj against the decision of the Independent Qualification Commission, no. 705, dated 18.10.2023.

At the end of the trial in the deliberation room, the panel, based on Article 66, point 1, letter “a” of Law No. 84/2016, “On the temporary re-evaluation of judges and prosecutors in the Republic of Albania”, unanimously decided:

 

Upholding the decision of the Independent Qualification Commission No. 705, dated 18.10.2023, concerning the re-evaluation subject Kujtim Bashaj.

 

This decision is final and has immediate effect.
