Justice institutions block the "Xhafaj" commission

The Justice Institutions have reacted in unison by announcing that they will not be part of the Xhafaj commission's activities.

Initially, it was the Constitutional Court which refused to be part of the meeting of the Xhafaj commission.

The President of the Constitutional Court, Holta Zaçaj, has stated that she will not send experts and representatives.

"We do not participate in law-making activities", stated Zaçaj.

After the Constitutional Court today, SPAK prosecutors also reacted, saying that they do not see it as reasonable to participate as they have made their problems public.

They have no obligation to be like that since it is the chief prosecutor of this institution who can participate, but SPAK is facing a very difficult task and cannot go to be questioned and give an account to Fatmir Xhafaj, who is the brother of Geron Xhafaj, extradited for drug trafficking in Italy.

"In response to your interest, we inform you that the request of the Special Parliamentary Committee 'On Deepening Reforms for Good Governance, Rule of Law, and Anticorruption for Albania 2030 in the European Union' (Commission) was very carefully analyzed by being dealt with at the Meeting of Special Prosecutors dated 09.03.2024.

During this meeting, the Special Prosecutors discussed the importance of cooperation with the Assembly for improving the rule of law and the fight against corruption and organized crime, always respecting the principle of separation and balance of powers.

Unanimously, all the Special Prosecutors did not consider it necessary to participate with an expert in this Commission, as they assessed that our institution has already fulfilled its legal obligations for making public the problems encountered during the exercise of its functions, including the needs for relevant legal changes.

This legal obligation has been realized through the publication of SPAK's Annual Reports on the official website, as well as periodic reports to the KLP and the Assembly. On the other hand, the Special Prosecutor's Office stated that it is ready to offer its contribution through the provision of legal opinions whenever it is considered necessary by this Commission", it is stated in the announcement of SPAK to the media.

Finally, the ILD and the Supreme Court have reacted, institutions which have declared that they will not participate in the meetings of the Xhafaj commission.

"The request does not fit our function", the Supreme Court said.

So all justice institutions have unanimously decided not to become part of the Xhafaj commission whose sole purpose is to hinder and stop the work of SPAK.

This is a failure of the "Xhafaj" commission, since none of the justice institutions will obey and will not be accountable to Fatmir Xhafaj.
