The Tirana court decided today that the former KLA soldier, Dritan Goxhaj, should be extradited to The Hague.

But the former Minister of Justice, Ylli Manjani, says that this decision, according to the law, is in the hands of the Minister of Justice, Ulsi Manjë.

He declares on social networks that if the minister and the government should reject the extradition of Goxhaj, as they should protect him as its citizen.

"The Minister of Justice (that is, the government of the Republic of Albania) is the official authority that decides whether or not Dritan Goxhaj will be prosecuted.

Regardless of what the court decides, the Minister (ie the government) has the right not to allow extradition. That's what the law says. The Convention on extraterritorial relations and the exchange of legal assistance also provides for this.

So, the government of the Republic of Albania is quite legitimate to protect its citizen, when it believes that extradition will put it under scrutiny or unjustified criminal prosecution.

Now, I don't know the circumstances of Dritan Goxhaj's involvement in the Hague investigations, but if an article in the media makes him under investigation, it seems absurd to me. Idiocy with a grain of salt, from what the Prosecutors of The Hague have made a habit of dealing with Albanians.

I recall here the absurd efforts of Carla Del Ponte, or the investigations that led to the innocence of Ramush Haradinaj, etc., I think that Dritan Goxhaj's involvement must be idiocy.

If this is the case, the government has a duty to know better than we do, extradition should be refused. The Minister of Justice has the authority to do this", emphasizes Manjani./ CNA
