Export of 8 tons of tomatoes with pesticides/ Berat Prosecution: Food fraud, 4

The Berat Prosecutor's Office has shared details from the investigations conducted so far regarding the discovery of the export of a quantity of 8 tons of tomatoes with the pesticide preparation "Chlorfenapyr" by an Albanian company to Croatia.

Through a statement, the Prosecutor's Office announced that it has determined four criminal offenses for this case, while emphasizing that it is a case of fraud with food products, which pose a risk to the health of citizens.

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Berat requested the detention of three citizens MQ, RL and GD, including two food safety inspectors, for the criminal offense of 'Importing, producing, selling and storing food dangerous to human health or life', 'Fraud with food products' and 'Forgery of documents' as well as for 'abuse of office', provided for by articles 288, 288/c, 186 and 248 of the Criminal Code. 

Following investigative and procedural actions carried out by the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Berat, in cooperation with the Economic and Financial Crime Section and the operational forces of the police, it resulted that the Croatian authorities ascertained and then destroyed a quantity of approximately 8 tons of tomatoes exported by the entity "Era-Fruit", with the administrator citizen MQ, a quantity that after analysis resulted in a level of the preparation "Chlorfenapyr" above the permitted norms, 0.06 mg/kg from 0.01 mg/kg which should be. 

Regarding this quantity, it turned out that citizen MQ had issued a fictitious purchase invoice from a farmer and used it for customs practices and the traceability report maintained by the AKU Berat, trying to avoid his legal responsibility for the product he produced and traded. 

The investigative actions resulted in the fact that this quantity of tomatoes dangerous to human health was produced and then exported by citizen MQ himself. This citizen is under indictment for the criminal offenses of 'Importing, producing, selling and storing foods dangerous to human health or life', 'Fraud with food products' and 'Forgery of documents'.

Also, from the investigative actions it resulted that the inspectors of the Berat AKU, citizens RL and GD, after notification from the Rasff system, carried out an inspection on 29.08.2025 at the entity "Era Fruit" and did not ascertain the quantity of tomatoes located in the entity's warehouse, fulfilling the practice as if no quantity of tomatoes were found there, thus not blocking and taking samples for conducting analyses for this product.

These inspectors accepted as legitimate the fictitious invoice issued by citizen MQ, not signed by the farmer/seller, based on it the product traceability report and distorting the facts regarding the origin of the product found to be problematic. 

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Berat, seized and took samples for analysis of various products such as tomatoes, peppers and cucumbers found in the entity "Era Fruit", these products suspected of being contaminated. /CNA
