Eduard Halimi: The SP's legal initiative, an illusory protective armor

Former Minister of Justice, Eduard Halimi, today explained the legal aspect regarding the amendment proposed by the Socialist Party to the Criminal Procedure Code.

In a television appearance, Halimi said that Article 242 is highly debated in terms of interpretation, while describing the change not as a reform, but as a shield.

According to Halimi, such a change resembles the practices of Eastern European countries.

"It is an amendment to Article 242 of the Code of Criminal Procedure. It is about the much-debated article in the Constitutional Court regarding the Prime Minister's request for the suspension measure by the GJKKO. This amendment is not a reform, but an emergency intervention for a specific situation, specifically for the "Balluku" case, as well as an attempt to create a shield for ministers who can sign. We are not dealing with reform. It is a change that resembles the practices of Eastern European countries. The same actions occurred in Romania in 2017–2018, when more than 200 mayors were put under investigation and an investigation was also requested against the Prime Minister and 50 MPs. The same situation occurred in Poland in 2023, when senior officials were placed under investigation. Likewise in Slovenia. These are emergency measures aimed at creating a protective "shield".
