The Court and the Special Prosecutor's Office seem to continue to have a complex to mention the name of the Mayor of Tirana, Erion Veliaj, in the investigations they have in progress.

This happened earlier with the Tirana incinerator file and the same thing was repeated in the investigation of the "5D" shpk affair.

In the 120 pages of the court decision, the name of the mayor Veliaj is never mentioned by name, although the entire investigative case is based on his important directors and, moreover, on a significant number of tenders developed directly by the Municipality of Tirana and won in abusive manner by "5D" shpk (formerly "VAS Construction")

However, beyond the complex to mention his name, the Special Court, however, has left a sign for the Prosecution, where it asks to investigate the holder of the Contracting Authority.

The decision does not mention more than which Contracting Authority. But, following the logic of the decision, it is clearly understood that it is about Erion Veliaj.

In the decision, it is specifically stated: "In relation to the facts and circumstances above, the court assesses that, following the investigations, the possible responsibilities of the holder of the contracting authority or the authorized officer should be investigated and evaluated, in relation to the legal obligations of to check the legality of the procurement procedures subject to proceedings, to assess whether there is an element of a criminal offense".

This paragraph in the court decision is preceded by the analysis of the elements of the criminal offense for Taulant Tushen, Enton Punavijan, Julian Zanaj and Albano Janku, who were the persons in charge of the tenders developed by the Contracting Authority, Municipality of Tirana, and won by "5D" Ltd.

Following the logical course of actions of the Prosecutor's Office and the Court's decision, it is clearly understood that the special judge has ordered the investigation of Erion Veliaj for the "5D" shpk affair.

Complex before the name "Erion Veliaj"

The company "5D" has won a significant number of tenders in 4 institutions (contracting authorities) related to the Municipality of Tirana.

Specifically, the tenders won by the company, which, according to SPAK, is actually owned by Mariglen Qato and Redi Molla, were developed by the contracting authorities: Tirana Municipality, Tirana Water-Sewage, Tirana Parking and Sports Club "Tirana".

SPAK, as well as the Special Court, are very specific when they mention the names of the holders of three of the four contracting authorities. Only in one case do they make an exception, not mentioning the name of the holder of the contracting authority - the one who runs the Municipality of Tirana, Erion Veliaj.

More specifically, in the court's decision regarding the Tirana Waterworks tenders, it is stated:

"Redi Molla, in the capacity of contracting authority, Ujësjellës-Kanalizime Tirana...has allowed the development of these procedures (acquired by VAS Construction, shn.red), 6 of which are in clear violation of the provisions of the law on public procurement..." .

Regarding the violations of the tenders developed by the contracting authority, "Tirana Parking", in the decision of the special court, it is stated:

"From the totality of the facts and circumstances... it turns out that the citizen Eglantina Zëre, in the capacity of the holder of the contracting authority "Tirana Parking"... has committed illegal actions, which have created advantages and privileges for the union of the operators 'VAS Construction' and 'Rroku Guest "...in relation to the fulfillment of the qualifying criteria...".

The same is repeated for violations in the procedures developed by the "Tirana" Sports Club, with the winner "5D" shpk.

The Court's decision states that:

"From the totality of the facts and circumstances...it results that the citizen Deborah Keçi, in the capacity of the holder of the contracting authority "Tirana Sports Club"...has committed illegal actions, which have created advantages and privileges for the operator 'VAS Construction'...in relation to the fulfillment of qualifying criteria...".

So, it seems clear that the Prosecutor's Office and the Special Court have no problem mentioning the names of the directors in Veliaj's dependency.
