President Bajram Begaj has returned the citizenship law to the Parliament for reconsideration.

Begaj declares that the amendments did not receive 84 votes, as the Constitution provides.

"For a law for which the Constitution has provided approval by qualified majority, specifically 84 votes, these amendments did not receive the required number of votes and cannot be called approved.

The Constitution in Article 78 defines that: "The Assembly decides by majority vote, in the presence of more than half of all its members, except in cases where the Constitution provides for a qualified majority", as defined in point 1 of Article 83 that " the draft law is voted three times: in principle, article by article and as a whole'.

The analysis of these provisions inevitably leads to the conclusion that the qualified majority is a requirement to which all three components of voting are subject, both voting in principle and voting by article and by article as a whole.

In the process of constitutional control, the finding of procedural violations, which contradict a constitutional provision (letter 'b' of point 2 of Article 81 of the Constitution) is a self-sufficient reason for the return for review of the law", argues the head of state. / CNA
