Accused of abuse of office/ SPAK sends Goro and two former directors to trial

SPAK sent the former Mayor of Himara, Jorgo, as well as the two former directors, Vasillaq Strakosha and Jerasimo Bashi, for trial. Jorgo Goro is accused of abuse of office.

The Special Prosecution Office Against Corruption and Organized Crime has filed a request to send the case to trial against the former mayor of Himara, Jorgo Goros, accused of "Abuse of office", after the completion of the investigations within the framework of criminal proceedings no. 127 of 2024, unified with criminal proceedings no. 298 of 2021.

The investigation has resulted in the defendant Jorgo Goro, in his capacity as former Mayor of Himara Municipality, having committed actions/omissions that constitute a regular failure to fulfill his duty, committed in violation of Article 17 of Law No. 9948/2008 “On the Review of the Legal Validity of the Creation of Titles of Ownership over Agricultural Land”, as amended, as well as points 1,2,3 of the Council of Ministers No. 253, dated 6.3.2013 “On Determining the Procedures for Completing the Acts of Acquisition of Agricultural Land in Ownership for Agricultural Families in the Villages of Former Agricultural Cooperatives”, to the detriment of several citizens, residents of Himara Municipality. 

Based on the relevant legislation in force, the analysis of the proven factual circumstances, the documentation administered, and the questions of witnesses, it is concluded that; citizen Jorgo Goro, in his capacity as Mayor of Himara Municipality in collaboration with citizens Jerasimo Bashi and Vasillaq Strakosha, have committed actions/omissions that constitute a regular failure to fulfill their duties, committed in violation of Law No. 171/2014 “On the Completion of the Legal Procedures for the Transfer of Agricultural Land of Former Agricultural Enterprises to the Ownership of Beneficiaries”, as amended, as well as in violation of the provisions of the Decision of the Council of Ministers No. 337, dated 22/04/2015 “On the Determination of the Procedures for the Completion of the Process for the Transfer of Agricultural Land of Former Agricultural Enterprises to the Ownership of Beneficiaries”, during the process of handling the submitted requests. 

Request of the Special Prosecution Office Against Corruption and Organized Crime to the Special Court for the trial of:

Jorgo Goro, former Mayor of Himara Municipality, accused of committing the criminal offense of "Abuse of office", (more than once according to the criminal facts described in the indictment) committed in collaboration as provided for in Article 248 and 25 of the Criminal Code. 

Vasillaq Strakosha, former Director of the Directorate of Land Protection and Management at the Municipality of Himara, accused of committing the criminal offense of "Abuse of office", (more than once according to the criminal facts described in the indictment) committed in collaboration provided for by article 248 and 25 of the Criminal Code (according to the criminal facts of criminal proceeding no. 298 of 2021 joined with criminal proceeding no. 127/2024. 

Jerasimo Bashi, former Director of the Directorate of Land Protection and Management at the Municipality of Himara, accused of committing the criminal offense of "Abuse of office", more than once committed in collaboration provided for by articles 248 and 25 of the Criminal Code. (according to the criminal facts of criminal proceeding no. 298 of 2021 joined with criminal proceeding no. 127/2024. /CNA
