In flagrant excess of its competences, the Constitutional Court stuck its nose where it did not belong, when it overturned the law on taxation of free professions. Globally, governance and fiscal reforms are the exclusive competence of the parliamentary majority. And the only authority that the taxman has to judge them is the sovereign, through his vote.

However, as if one wrong decision was not enough, the court added another, even more serious one, producing through them a Constitutional coup.

Because before the Court overturned the law, a good part of self-employed businesses had paid the first installment of the tax, the government has officially turned to the Constitutional Court to state what it should do about this issue. Through an absurd answer, the Constitutional Court has replied that its decision does not affect those who have paid the installment. So whoever ate it, ate it.

In short, the Constitutional Court has formalized with two of its decisions, one more illegal than the other, the greatest inequality that the state in Albania has ever imposed on its citizens. And this madness may not be so naive.

In the corridors of the Ministry of Finance, it was said that the reason for dropping the tax on free professions was the personal interests of the judges of the Constitutional Court. The sisters, wives, sisters-in-law and relatives of the members of the Constitutional Court are mostly self-employed businesses. Some with law firms, others with consulting firms and so on.

For people in power, these businesses are often a very efficient instrument in money laundering and legalization of income that originates from corruption. Now SPAK has to perform a very simple verification. How many of the people close to the members of the Constitution have paid the first installment of the tax and how does this indicator stand in relation to the average.

If the relatives of the Constitutional judges have not paid the installment, this would be a strong indication of corruption. Because using inside information stemming from public office for personal purposes is theft.

Doubts that this happened are reinforced by the second decision of the Constitutional Court on this matter. If their people have not paid the installment, the members of the Court have no incentive to cancel the installments paid. Therefore, all this deserves to be investigated by SPAK.

But now the situation is this. Both decisions of the Constitutional Court on the tax on free professions have practically created an unconstitutional coup, where within the same sector some businesses have paid the tax, while others have not. And this is not the Constitutional Court, but the Coup Court.
