Accused of a series of criminal offences/ GJKKO leaves the Turkish citizen in

GJKKO has upheld SPAk's request for the continuation of the "prison arrest" security measure for Yalcin Hanci, the Turkish citizen who is accused of being a member of a criminal group that trafficked illegal immigrants.

Yalcin Hanci, accused of committing the criminal offenses "Aiding illegal crossing of borders", "Structured criminal group", "Commitment of criminal offenses by criminal organization and structured criminal group", provided by articles 298 first paragraph , 28 point 4, 333/a first paragraph and 334 point 1 of the Criminal Code.

The applicant, the Special Prosecutor's Office against Corruption and Organized Crime, on 03.09.2024 submitted to the Court the request with the object: "Interrogation of the defendant Yalcin Hanci and verification of the conditions of implementation of the personal security measure "Arrest in prison", provided from article 238 of the Penal Code".

2. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judges Etleva Deda, Ardit Mustafaj and Bib Ndreca, based on articles 112, 232 point 1 letter "dh", 238 , 244 and 245 of the Criminal Code, with decision No. 113, dated 04.09.2024, decided:

1. Accepting the request of the Special Prosecution Against Corruption and Organized Crime.

2. Continuation of the implementation of the coercive personal security measure "Arrest in prison", provided by article 238 of the Criminal Code, determined by Decision no. 2, dated 09.01.2022, of the Special Court of First Instance for Corruption and Organized Crime, against the defendant Yalcin HANCI, accused of committing the criminal offenses "Aiding illegal border crossing", "Structured criminal group ", "Commitment of criminal offenses by criminal organizations and structured criminal groups", provided by articles 298 first paragraph, 28 point 4, 333/a first paragraph and 334 point 1 of the Criminal Code.

3. The Special Prosecution Against Corruption and Organized Crime is ordered to execute this decision.

4. Against this decision, an appeal can be made to the Special Court of Appeal for Corruption and Organized Crime in Tirana, within the legal deadline./ CNA
