QUINT: Non-implementation of the decision on the Monastery of Deçan

The heads of the missions of the United States of America, France, Germany, Italy, the United Kingdom, and the European Union have repeated the call to the Government of Kosovo to fully and urgently implement the land registration of the Deçan Monastery.

In a statement by QUINT, it is stated that despite the decision of the Constitutional Court of 2016, that decision on the land is not being implemented.

"We are united in support of the democratic and European future of Kosovo. Enforcing the rule of law and respecting the independence of the judiciary are obligations for all democratically elected governments and necessary preconditions for Kosovo's integration into European and Euro-Atlantic institutions, including further progress in Kosovo's application for membership in the Council of Europe. Europe. Further delay is only a hindrance to this progress," their joint statement said.

The court dispute over the issue of who owns 24 hectares of land and forest - social enterprises "Apiko" and "Iliria" or the medieval monastery of Deçan - has lasted 16 years.

On May 20, 2016, the Constitutional Court of Kosovo made a decision in favor of the Monastery of Deçan, but it was not implemented, although the decisions of the Constitutional Court are final and binding for all parties.

However, the local authorities of Deçan do not implement this decision even to this day, considering that this area was taken by force in the 90s, by the regime of the then Serbian leader, Slobodan Milosevic.

For several years now, the international community has called on the institutions of Kosovo to implement this decision of the Constitutional Court and allow Manastir to register the land in the cadastre./ REL
