The Constitutional Court of Kosovo has published the full verdict regarding the election of the Deputy Speaker of the Assembly from the ranks of the Serbian community, emphasizing that the Deputy Speaker is proposed by the majority of deputies from this community.
The full judgment is published a few days after the Constitutional Court published a notice regarding this decision regarding the election of Nenad Raši? to the position of Deputy Speaker during the previous legislature, finding that he was elected in violation of the Constitution and the Rules of Procedure of the Assembly.
"The candidate for Deputy President of the Assembly from among the deputies of the Serbian community is proposed by the majority of the deputies of the Serbian community; while the candidate for Deputy President of the Assembly from among the deputies of other communities that are not in the majority is proposed by the majority of the deputies of other communities that are not in the majority, in accordance with the formal requirements and in good faith," the judgment states.
Raši?, leader of the For Freedom, Justice and Survival party, was elected vice president from the ranks of the Serbian community in October 2025, through a lottery initiated by the Speaker of the Assembly, Dimal Basha.
The draw was organized after the Serbian List - which had nine deputies and will have the same number in the new legislature - did not receive the necessary votes, and the draw was organized.
His election was contested by the Serbian List, the main Serb party in Kosovo that has the support of Belgrade.

The court said that the right to propose the vice-president from among the Serb community belongs to the majority of deputies from this minority.
The verdict stated that the activation of the lottery unblocking mechanism, "exceptional circumstances must arise, in which case the majority of deputies from communities that are not in the majority would not propose candidates."
The highest legal institution in the country said that in this specific case, nine candidates from the Serbian community were voted in three times each, after being proposed by their representative.
“Rrjedhimisht, Gjykata vlerëson se shumica e deputetëve nga radhët e komunitetit serb ka shfrytëzuar të drejtën e propozimit për nënkryetar të Kuvendit, respektivisht, anëtar të Kryesisë së Kuvendit, si dhe pas kërkesës nga kryetari i zgjedhur i Kuvendit që të propozohet deputeti i mbetur i pa votuar nga radhët e komunitetit serb, përfaqësuesi i shumicës së deputetëve në radhët e komunitetit Serb kërkoi ripropozimin e kandidatëve nga kjo shumicë bazuar në të drejtën e përcaktuar në paragrafin 4 të nenit 67 të Kushtetutës në lidhje me nënparagrafin 1 të paragrafit 6 të nenit 12 të Rregullores së Kuvendit”, u tha në aktgjykim.
Në vendim thuhet se përderisa i takon Kuvendit që të vlerësojë rrethanat që e bëjnë të domosdoshëm aktivizimin e mekanizmave debllokues, “Gjykata thekson fuqishëm që këto mekanizma nuk mund të përdoren si procedurë e rregullt e zgjedhjes së kryetarit/nënkryetarëve, por vetëm në rrethana të caktuara, kur një gjë e tillë është e domosdoshme për të debllokuar procesin e konstituimit të Kuvendit dhe vetëm në masën që një gjë e tillë i shërben qëllimit kushtetues për çka këto mekanizma janë përcaktuar”.
“Në parim, ashtu siç është theksuar më herët, propozimet nga grupet parlamentare apo deputetët që gëzojnë të drejtën e propozimit, në frymën e mirëbesimit dhe bashkëpunimit, duhet të synojnë arritjen e konsensusit, të sigurojnë votat e nevojshme dhe të rezultojnë në zgjedhjen e kandidatëve ashtu siç janë propozuar dhe siç parashihet me Kushtetutë. Për më tepër, duke u mbështetur në përcaktimet kushtetuese të lartcekura, ky parim ka rëndësi të veçantë për garantimin e së drejtës së përfaqësimit të komuniteteve që nuk janë shumicë, të cilat nuk disponojnë numrin e nevojshëm për të siguruar vetë zgjedhjen e përfaqësuesve të tyre në kryesinë e Kuvendi”, thuhet në aktgjykim.
Kushtetuesja thotë se shorti nuk mund të përdoret si mekanizëm në rrethanat kur shumica e deputetëve të Kuvendit do të përcaktonte përfaqësuesin e një komuniteti joshumicë, pa propozimin e këtij komuniteti, pasi argumenton se kjo, “në thelb, do të përbënte anashkalim të garancive kushtetuese dhe atyre të përcaktuara në Rregulloren e Kuvendit”.
Pas njoftimit për aktgjykimin, të publikuar nga Kushtetuesja më 28 dhjetor, kryetari i Kuvendit, Dimal Basha, e kishte kritikuar atë, duke vlerësuar se përmbante “gabime thelbësore në interpretim dhe zbatim të normave përkatëse”.
Ai vlerësoi se pretendimet e Gjykatës Kushtetuese “janë të pabaza” sa i përket zgjedhjes së nënkryetarit nga radhët e komunitetit serb.
Basha deklaroi se Rashiq nuk u propozua nga shumica e deputetëve serbë, pasi siç argumentoi ai, nga shumica e këtyre deputetëve nuk ka pasur propozim.
“Me fjalë të tjera, vetë Gjykata Kushtetuese po e pranon se shumica e deputetëve nga komuniteti serb nuk e kanë propozuar zotin Rashiq, pra kemi pasur të bëjmë me refuzim, apo ndryshe thënë mospropozim nga ana e tyre”, shkroi Basha në rrjetet sociale.
On October 16, 2025, the Serbian List filed a complaint with the Constitutional Court regarding the election of the Deputy Speaker of the Assembly from among the Serb community, claiming that the Constitution, the Rules of Procedure of the Assembly, as well as a previous judgment of the Constitutional Court, were violated.
The highest court in the country had already handled a complaint by the Serbian List regarding the issue of deputy speakers, after the Speaker of Parliament Dimal Basha declared the Assembly constituted without the election of a fifth deputy speaker from the Serbian community.
The Court then found that the Assembly was not constituted, requiring the deputies to elect the deputy speaker from among the Serb community, in order to pave the way for the formation of the Government.
In that decision, the Constitutional Court said that the proposal for the deputy speaker from among the non-majority communities, in this case the Serbian minority, must be made by the majority or the largest number of deputies from among the deputies of the Serbian community. /REL
