The explosion of the warehouse in Lushnje/ Accusations against the MP of the SP,

The Prosecutor's Office of Fier has declared incompetence in the case of the explosion of the warehouse in Lushnje.

The accusations against the MP of the SP, Bujar Çela, are "Violation of the rules of protection at work", "Illegal construction", and "Destruction of property due to carelessness", provided by articles 289 prg. 2, 199/a prg 4, and 161 of the Criminal Code.

Also, the Prosecution requested the suspension of the Lushnje IMT inspectors, MP, ES, KS, IU and RK citizens.

The prosecution also issued a restraining order for citizens L.Gj, which was executed by the judicial police, which is the entrepreneur of the construction of the warehouse.

Fier Prosecutor's Office announcement

The Prosecutor's Office at the Court of First Instance of Fier General Jurisdiction registered on 03.03.2024 criminal case no. 358, for the criminal offenses "Violation of the rules of protection at work", "Illegal construction", "Abuse of duty" and "Destruction of property by negligence", provided by articles 289 prg. 2, 199/a prg. 4, 248 and 161 of the Criminal Code.

This criminal case was registered in relation to the event that occurred on 01.03.2023, around 3:30 p.m., in the "Karbunarë e Poshtme" neighborhood, Administrative Unit No. 5, Lushnjë, where as a result of a powerful explosion during construction works construction in the "warehouse" facility, belonging to the citizen B.Ç, two people died and seven others were injured.

On the part of the judicial police, under the guidance of the ready prosecutors, who were present at the scene of the incident, procedural actions were carried out, such as inspection of the scene of the incident, technical construction expertise, seizure and examination of documents, interrogation of many persons and other investigative actions related to the nature of the event.

After the administration of the above data and their cross-checking, the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Fier has registered the names of 7 (seven) persons to whom the criminal offense is attributed, as follows:

- B.Ç citizens, for the criminal offenses "Breach of the rules of protection at work", "Illegal construction", and "Destruction of property due to carelessness", provided by articles 289 prg. 2, 199/a prg. 4, and 161 of the Criminal Code.

- Citizens L.Gj, for the criminal offenses "Violation of the rules of protection at work", provided by article 289 prg. 2 of the Criminal Code.

- Citizens RK, KS, MP, ES and IU, for the criminal offense "Abuse of duty", provided by article 248 of the Criminal Code.

As part of the investigation of the criminal case, the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Fier has issued a restraining order for citizens L.Gj, which was executed by the judicial police.

Also, the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Fier has asked the court to assign security measures of a prohibitive and coercive character "Suspension of the exercise of a duty or public service" and "Prohibition of exiting the country", provided by articles 242 and 233 of the Code of Criminal Procedure, to the following citizens:

- RK citizens, with the duty of chief inspector of the Territory Protection Inspectorate, Lushnjë Municipality.

- To citizens MP, ES, KS, with the duty of inspectors of the Territory Protection Inspectorate, Lushnjë Municipality.

- IU citizens, with the duty of general inspector of Municipal Unit No. 5, Lushnjë Municipality.

The Court of First Instance of Fier General Jurisdiction has accepted the above requests of the prosecution and currently the court's decision has been executed.

In the following, the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Fier, based on articles 28 point 1, 75/a, letter "c" and 84 of the Code of Criminal Procedure, has announced the incompetence of the subject and has sent the acts of the criminal case The Special Prosecutor's Office Against Corruption and Organized Crime, Tirana, as the competent prosecutor's office due to the subject, to continue the investigations against the citizen B.Ç, deputy of the Parliament of Albania./ CNA
