Violation of rules in a court session/ ILD requests disciplinary action against

The High Inspector of Justice, upon completion of the investigations, has requested disciplinary measures for the judge of Kukës, Ajshe Xhafa.

A hearing on the disciplinary proceedings against the magistrate is taking place today at the High Judicial Council.

Regarding the reasons for launching this investigation, the ILD notes that the basic information was reflected in a report in September of last year.

"This investigation was initiated based on the review of information reflected in the minutes of a general meeting of judges in September 2024, during which debates were held on several work processes in the court," the ILD reports.

According to the report, the ILD assesses the magistrate's behavior as a "minor disciplinary violation" and requests the disciplinary measure "public reprimand" for Judge A.Xh., provided for by Article 105.

"The High Inspector of Justice concludes that the behavior and actions of magistrate A. Xh., in this case, are assessed as a "minor disciplinary violation". The disciplinary measure itself contains special prevention, in the sense that the magistrate does not commit disciplinary violations in the future; and general prevention, in the sense that other magistrates understand that such inappropriate behavior should not be committed, as it is punishable by disciplinary measure. ILD requests the disciplinary measure "public reprimand" for judge A.Xh., provided for by article 105 point 1 letter "b" and article 107 of law no. 96/2016 "On the status of judges and prosecutors in the Republic of Albania", as amended", - the ILD report states./ CNA
