In respect of the citizens, the media and the right to information, starting from the two announcements made by the Korçë General Jurisdiction Prosecutor's Office, regarding the investigative and procedural actions carried out by the Korçë Local Police Directorate and the Pogradec Police Station and the procedural materials forwarded in the Prosecutor's Office on the part of the Police for the event that happened on 10.08.2024 in Pogradec, with regret for these reactions, we clarify the public opinion that:

The Korça Prosecutor's Office initially raised the claim that the State Police had not brought the legal expert report along with the arrested persons for the incident, but we clarify the public opinion that the expert report is carried out by the Scientific Police Institute, as opposed to the decisions on conducting the examination, and never this it is not done on the spot for the very way the process works and the compilation of the Expertise Act.

In the second reaction, the Prosecutor's Office announced the filing of a charge of abuse of duty against an employee of the General Patrol of the Pogradec Police Station regarding the incident, accusing him of not having taken any measures to document or disclose the cause of death. of the EP citizen on 10.08.2024 in Pogradec.

But the fact is that the employee of the General Patrol, Inspector AL, suspected of the criminal offense "Abuse of duty", has nothing to do with the police investigation of the event, nor with the police operation to catch the perpetrator. The investigation of the event is carried out by the Judicial Police Officers and the investigative group under the direction of the Prosecutor's Office, while the employees of the General Patrol have other functional tasks at the scene, excluding investigative ones.

This is based on the job descriptions of the General Patrol Officer, service corps, approved by Order No. 1024, dated 10.07.2023, "Main Responsibilities", point "c", letter "q", where it is defined: "Ensures the place of event to prevent the alteration/destruction of evidence and to ensure its security. It identifies victims, informants and witnesses, provides necessary information from them, as well as identifies and accompanies the suspect".

Upon arriving at the scene, the police officer Inspector AL communicated with those present, secured the scene, informed the operating room about the incident, the generals of the injured, as well as the request for medical assistance. After the arrival of the ambulance, he accompanied the police vehicle to the hospital, where he waited to receive information on the state of health of the injured.

Upon receiving the notification from the doctors, he notified the investigative team that the injured person has passed away.

We clarify public opinion that the General Patrol employee has fulfilled all functional duties.

In respect of the independence of the judicial bodies, we do not comment on the reasons or causes of these judgments of the Prosecutor's Office, just as we did not comment on the accusation of "manslaughter" without waiting for the act of forensic expertise and rejecting the accusation raised by the State Police for "intentional murder".

We clarify the public opinion that there is no connection between the General Patrol employee who has been charged and the investigation of the incident, for which the State Police has caught, arrested and brought to justice the suspected author of the incident.

Also, in relation to the investigation of this event, the Police has sent to the Prosecutor's Office all the necessary investigative materials that are carried out at the scene and during the preliminary investigation, procedural materials which have been submitted to the Prosecutor's Office with a protocol number, which refutes the Prosecutor's charge of deficiencies in the acts referred by the Police.

We emphasize that the rigorous control of the Police Supervision Agency has found all the steps taken by the local police structures to clarify the incident to be in full compliance with the mission and the law.

The State Police remains maximally engaged to implement the law, to react in time and with professionalism to prevent and investigate criminal events, to respect and protect the basic rights and freedoms of citizens, as well as to offer them a service as high quality as possible.
