The company MABCO has filed a complaint with the Special Prosecutor's Office against Judge Miranda Naka. MABCO accuses the judge of blocking the change of VIA's administrator and issuing a decision that, according to the company, contradicts the Supreme Court's decision.
Among other things, the company has announced the initiation of international arbitration proceedings. The following statement also states that Valon Ademi has taken de facto control of the airport for more than a month, due to the inaction or support of Albanian institutions, blocking the project's activity.
Further, MABCO emphasizes that its goal is not conflict but the protection of its investment and the restoration of legal administration of Vlora Airport.
Statement:
MABCO is filing a complaint with SPAK against Judge Miranda Naka, accusing her of blocking the change in VIA's administration and issuing a decision that, according to the company, contradicts the Supreme Court's decision.
The company announces the initiation of international arbitration proceedings.
Albanian institutions have failed to protect the investment and unblock the Vlora Airport construction site.
The partner with 2% of the quota, Valon Ademi, has taken de facto control of the airport, blocking the project's activity for more than a month with the support or inaction of state institutions.
The President of the Republic, political parties, parliamentary groups and the diplomatic corps have been informed by letter, raising concerns about legal certainty, the protection of foreign investors and respect for private property in Albania.
MABCO emphasizes that it owns 98% of VIA's shares and warns that any contract or agreement concluded without its approval will be faced with all legal means, demanding full implementation of the Supreme Court's decision.
MABCO is simply seeking its legal rights. The company emphasizes that its goal is not conflict but the protection of its investment and the restoration of legal administration of Vlora Airport, in accordance with the rights deriving from its ownership of 985 of VIA's shares.
Two days ago, businessman Behgjet Pacolli reacted to the decision of the Tirana Court to freeze the current situation of the company VIA sh.pk, until a final decision is made.
He expressed that it is disturbing that a lower-level court would ignore, annul, and openly challenge the decisions of the Supreme Court Panel, deciding differently on the same legal issues previously handled by the highest instance of justice.
The businessman emphasizes that such a practice, in addition to severely harming the party, violates legal certainty, the judicial hierarchy and citizens' trust in the justice system, and also seriously damages the image and seriousness of the Albanian state. /CNA
