"Those under the jurisdiction of SPAK or GJKKO do not benefit"/ Gogu

The Minister of Justice, Toni Gogu, has presented the Criminal Amnesty draft law to the Committee on Legal Affairs. Gogu clarified during his speech who benefits from this criminal amnesty.

The Minister explained that those convicted of corruption, organized crime and for matters that fall under the jurisdiction of SPAK and GJKKO do not benefit from this amnesty.

According to him, this draft law distinguishes with legal precision between a person who poses a danger to society and a person who the state considers has fulfilled the purpose of the sentence and needs to be reintegrated into society.

Meanwhile, it is reported that the draft law is expected to be voted on in the plenary session on June 18.

Gog's speech to the committee:

I want to start with three numbers. 380 people gain immediate freedom from this draft law, 900 people benefit from a reduction in sentence, and 0 people convicted of corruption, organized crime, and for matters within the jurisdiction of special anti-corruption structures benefit from this amnesty.

No one under the jurisdiction of SPAK or GJKKO benefits from this amnesty. These three numbers summarize the philosophy of this bill.

This draft law does not tolerate crime, but distinguishes with legal precision between a person who poses a danger to society and a person whom the state assesses has fulfilled the purpose of the sentence and needs to be reintegrated into society.

This law does not extinguish any civil rights of the victim. The amnesty affects the relationship between the state and the perpetrator of the criminal offense. The victim's right to compensation remains intact.

The draft law operates in three directions:

- The first is amnesty from serving the sentence, they are amnestied according to the following criteria:

All men who have been sentenced to up to 3 years or have less than 3 years left to serve are released immediately.

All women who have been sentenced to up to 4 years or less are released immediately.

All men over 60 and all women over 50 are immediately released.

Juveniles, 18 years of age or younger at the time of the crime, are released immediately.

- The second criterion has to do with reducing the sentence.

All convicts receive a 1-year reduction, while women and minors receive 1 and a half years.

- The third is amnesty from criminal prosecution.

Proceedings are suspended for offenses punishable by up to 3 years, with the following exceptions:

None of the beneficiaries must have committed serious crimes.

All murders under qualifying circumstances, sexual crimes, trafficking, terrorism, corruption and organized crime, electoral offenses, money laundering, and any subject that is under the jurisdiction of SPAK and GJKKO are excluded.

There are 5292 places in the penitentiary system, 4769 people have been accommodated. After the amnesty, we will have a 10% reduction in the population of the penitentiary system. This effect is not the main purpose of the law, but it is a desired consequence, because it gives us the opportunity, when the number of convicts is reduced, to increase the quality of treatment for others. / CNA
