Law on recognition of years of service/ Pensioners file lawsuit with the Constitutional Court

The Albanian Pensioners Association "Thinjat" has launched a legal battle against the government, challenging in the Constitutional Court some of the key provisions of Law No. 7/2025 on the recognition of employment periods for pension purposes.

The request was filed on March 17 and is expected to be reviewed by Judge Marsida Xhaferllari, who has been appointed rapporteur for the case.

At the heart of the lawsuit is the way the law treats years of service completed during the communist system, particularly for former employees of state-owned enterprises, agricultural cooperatives and public institutions of the time. According to the association, several articles of the law impose restrictions that directly affect the calculation of pensions, by excluding or reducing the value of certain periods of service.

Specifically, “Thinjat” requests the repeal of part of Article 3, as well as Articles 4 and 5, considering them to be in conflict with the Constitution. According to the arguments presented, these provisions violate the principle of equality and legal certainty for pensioners.

Law No. 7/2025 aims to regulate the recognition of years of work for thousands of citizens who contributed to the economy during the socialist period, but its interpretation and implementation has caused dissatisfaction among some beneficiaries.

The court's decision is expected to be decisive not only for the fate of the contested provisions, but also for how pensions for this category of citizens will be calculated in the future. /CNA
