Socialist MP Damian Gjiknuri, at today's session of the Laws Committee, asked Chief Prosecutor Olsian Çela about the new Criminal Code.

In his response, the Chief Prosecutor said that he did not refuse to cooperate in creating the draft, but emphasized that there is a very short time to accomplish what is needed. He emphasized during his speech that the technique used to write the new Criminal Code is not up to par.

The Chief Prosecutor said that the best way to create a new Criminal Code is to create an inter-institutional group with the best and with local and foreign experts. But according to him, an analytical answer to 900 provisions cannot be given in two or three months.

"I didn't say I refuse. But I refuse today to talk about the elements of the Criminal Code. The technique used to write the Code is not up to par. Second, many things are related to criminal policy. We are not the ones to determine whether a certain behavior is punishable or not. You do that. I maintained that the spirit of the code is repressive. We give opinions, but it's how I think and how you think.

On September 9, the draft was officially submitted for discussion. Several consultation rounds were held in several districts. On October 10, we received an invitation for a welcoming speech. You really think that this can be done in a month. If you want to make a serious Code, you also need foreign experts. But this takes time. No one can give an opinion in 10-15 days.

This needs a methodology. This is not done with round tables in districts. So either it will be a serious process, we need to gather the best we have, build an inter-institutional group with local and foreign experts. But if it has to be done quickly, we do it quickly. The approach is important. With all the negative opinion that I have about the draft and not only me, let's redo it, but it won't be done in two or three months. The way it is going is not correct.
