
With a 7-page letter, SPAK sent today a request to the Assembly, regarding MP Sali Berisha.
The Special Prosecutor's Office requested authorization from the Assembly to establish a stricter security measure for Berisha.
In the letter provided by CNA, the suspicions of the Prosecution regarding the commission of criminal offenses "passive and active corruption of high state officials in cooperation" are listed, as well as cleaning of the products of the criminal offense or criminal activity in cooperation, committed by high officials state or local elected officials".
SPAK claims that Berisha, in his capacity as Prime Minister, has favored the privatization procedures of the former "Partizani" complex and the direct beneficiary has been Malltezi.
On the land of the former "Partizani" complex, Malltezi, as an investor from the company "Homeplan" sh.pk, has carried out constructions and the benefits are calculated in the amount of 672 billion ALL or 5 million euros.
SPAK today requested a strict security measure to "force" appearance, because Berisha never appeared before the BKH officers.
"With decision no. 117 dated 26.10.2023, the Special Court of First Instance for Corruption and Organized Crime in Tirana, has decided, among other things, the continuation of the coercive personal security measure "Compulsion to appear before the judicial police", provided from article 234 of the Penal Code, determined by decision No. 112 dated 20.10.2023 against the person under investigation Sali Berisha, ordering the latter to appear on the first and third Monday of every month, at 10:00 a.m. before the officer of the judicial police, at the Special Prosecutor's Office Against Corruption and Organized Crime, as well as ordering this citizen not to leave the territory of the Republic of Albania, without the authorization of the court, in reference to article 233 point 1 of the Criminal Code and prohibition of the use of the passport and other valid identification documents for exiting the country.
Disagreeing with the above two decisions, the person under investigation and his defenders filed an appeal. The Special Court of Appeal for Corruption and Organized Crime, Tirana, with decision no. 56 dated 21.11.2023, decided, among other things, the approval of decision no. 112 dated 20.10.2023 of the Special Court of First Instance for Corruption and Organized Crime, verified by decision no. 117 dated 26.10.2023 of the same court, against the appellant Sali Berisha.
Referring to the minutes dated 06.11.2023, 20.11.2023 and 04.12.2023 kept by the judicial police officer/investigator, before whom the person under investigation Sali Berisha had to appear, it turns out that the latter did not implement the court's decision, by never appearing before the judicial police", the letter states, among other things.
For this case of the Special Prosecutor's Office, the Assembly is expected to convene, which will decide whether or not to remove Berisha's immunity./ CNA
