15 thousand documents available to SPAK for fictitious auctions/Albanians'

The properties of Albanians are being devoured by microfinance companies. The serious phenomenon has been denounced by the National Chamber of Private Bailiffs, which has made available to SPAK more than 15,000 documents and acts, which show in detail the fictitious auctions held with the properties of Albanians. 

From the institution headed by Tedi Malaveci, it is clarified that other documents for this criminal activity will be deposited in SPAK. 

"The incriminating material addressed to the SPAK is accompanied by an evidentiary documentation with about 15,000 documents and acts that is being supplemented with other acts for the special prosecution body, for every day that at the Chamber, new evidence and facts are addressed and administered , referring to one of the most serious criminal activities that occurred in recent years, started in 2016, that if it is not stopped today, incurable gangrene will spread rapidly throughout the Albanian society. The consequences of this criminal activity are calculated in advance to have managed to affect a good part of the population in the whole country", says the communique of this institution. 

According to the National Chamber of Private Bailiffs, hundreds of denunciations addressed to this institution clearly speak of the development of a genuine and well-organized criminal activity, for the benefit of several non-bank financial institutions, "Micro Credit Albania" and "Final".

This institution denounces that in 31 municipalities of the country, over a thousand fictitious auctions have been held where citizens do not yet know whether their properties were taken or robbed by "Micro Credit Albania" or "Final", with the "online" method at the local directorates of Cadastre.

Meanwhile, from communications with municipalities throughout the territory, it is estimated that over 4,000 fictitious property and real estate auctions have been announced. 

"From a preliminary survey, it is estimated that the victims of fictitious auctions are many individuals who do not live or reside in Albania. The data deposited with SPAK is complete, for every individual, citizen who has fallen prey to this structured criminal group ; written data and facts that show thousands of auctions for the sale of thousands of real estates of Albanian citizens, all with ridiculous values, with the sole aim - the final goal - of the transfer of properties from apartments to land, owned by this group organized crime ," the communiqué further states. 

Kallëzimi në SPAK, nga ky institucion është depozituar më 20 nëntor ndaj 13 personave për ankandet fiktive, ku përfshihen përmbarues, ish-përmbarues, vlerësues të pasurive të paluajtshme, përfaqësues ligjorë dhe ortakë të institucioneve financiare jo banka, si dhe persona të lidhur me ta. 

Të 13 personat akuzohen për shpërdorim detyre, mashtrimi, pastrimi i produkteve të veprës penale ose veprimtarisë kriminale dhe përvetësimit të titullit apo detyrës shtetërore. 

"Dhoma Kombëtare e Përmbaruesve Gjyqësorë Privatë ka ndërmarrë më datë 20.11.2023 veprime konkrete duke depozituar në SPAK kallëzim penal për një Grup të Strukturuar Kriminal që në bashkëpunim ka konsumuar në vazhdimësi veprat penale të “Mashtrimit” me pasoja të rënda, të kryer në bashkëpunim dhe më shumë se një herë, “Pastrimi i produkteve të veprës penale ose veprimtarisë kriminale”, “Shpërdorim detyre”, “Përvetësimi i titullit apo detyrës shtetërore”. Personat e përfshirë në Grupin e Strukturuar Kriminal e të kallëzuar nga Dhoma janë 13 individë/shtetas, ku përfshihen përmbarues, ish-përmbarues, vlerësues të pasurive të paluajtshme, përfaqësues ligjorë dhe ortakë të institucioneve financiare jobanka, si dhe persona të lidhur me ta", thuhet në njoftimin e DhomëS Kombëtare të Përmbaruesve Gjyqësorë Privatë. 

Dhoma Kombëtare e Përmbaruesve Gjyqësorë Privatë bën me dije se po ndjek çështjen nga afër dhe do të bashkëpunojë çdo ditë me organin e akuzës speciale për të stopuar njëherë dhe përgjithmonë këtë fenomen.

"Kjo veprimtari kriminale prej vitesh ka atrofizuar jetesën e mijëra familjeve shqiptare, kjo nën trysninë e pashpirt të Shërbimit të Përmbarimit Mikrofinanciar dhe që prej 10 muajsh të këtij viti, po gllabëron pa asnjë skrupull moral e ligjor pronat dhe pasuritë e paluajtshme të familjeve shqiptare", thuhet në komunikatë.

Ky institucion u bën thirrje mediave dhe gjithë publikut të gjerë të "shohin faktet që po i sjellim me aktet bashkëngjitur dhe të njoftojnë njëri-tjetrin, të gjithë individët dhe familjet e prekura nga ky grup i strukturuar kriminal, që aktualisht prezantojnë vetëm 1305 raste të ankandeve fiktive të shpallura për shitje pronash, por që janë shumë më tepër dhe që mund të kenë përfunduar me grabitjen e tyre".

Më tej, Dhoma Kombëtare e Përmbaruesve Gjyqësorë Privatë u kërkon qytetarëve të verifikojnë sa më shpejt, pranë administratës së bashkive dhe gjykatave ku kanë pronat, nëse pasuritë e tyre të paluajtshme janë përfshirë në ankandet fiktive deri ditën e këtij njoftimi. 

"The National Chamber encourages all citizens who may doubt the quiet enjoyment of their properties, to verify without wasting time this list that we are bringing today to the cadastral offices of the respective cities and to check the status of their property. We call on the citizens to verify as soon as possible, with the administration of the municipalities and the courts where they have properties, if their real estate has been included in the fictitious auctions until the day of this announcement. We call on all the deceived who have bought back their properties with a "donation" from new microfinance owners to not be afraid and tell their truth in SPAK, near the Chamber, in the media, everywhere. No one can blackmail them anymore! The National Chamber is ready to welcome, help and guide anyone from thousands of citizens who have fallen prey or without their knowledge have remained hostages of this criminal scheme, which in a short time, if it was not strongly denounced, could turn into a social, national drama", the communiqué concludes.

A few days ago, the National Chamber of Private Bailiffs raised concern about the phenomenon of "fictitious auctions" that has spread significantly and has seen a large increase in recent months. 

This institution emphasizes that the courts and municipalities throughout the country are witness to the fictitious announcement of tens of hundreds of fictitious auctions for the sale of Albanian real estate./ CNA
