"The mandate of some members under discussion"/ Bardhi: The majority

The head of the Democratic Party Parliamentary Group, Gazment Bardhi, has stated that for a long time there has been a tendency from the majority to keep the Constitutional Court destabilized by putting into question the mandate of some of its members.

According to Bardhi, this game has been going on for months, while the Constitution and the organic law are quite clear: Apart from two judges (Holta Zaçaj - 2025 and Sandër Beci - 2028), the Constitution and the law have provided for a full 9-year mandate for all other constitutional judges.

He emphasizes that the continuation of this game and any different reading of the Constitution and the law is seriously undermining the independence and impartiality of constitutional judges.

Bardhi underlines that this constitutes an attempt to capture and place the Constitutional Court under political control by the majority.

"The independence of the Constitutional Court is essential for guaranteeing the rule of law. For a long time, there has been a tendency of the socialist majority to keep the Constitutional Court destabilized, by calling into question the mandate of some of its members."

This game has been going on for months now, while the Constitution and the organic law are quite clear: Apart from two judges (Holta Zaçaj - 2025 and Sandër Beci - 2028), the Constitution and the law have provided for a full 9-year mandate for all other constitutional judges.

Therefore, the continuation of this game and any different reading of the Constitution and the law is seriously undermining the independence and impartiality of constitutional judges.

"This constitutes a clear attempt to capture and place under the political control of the majority the supreme guardian of the Constitution, the Constitutional Court. And this is undoubtedly an attempt to annihilate the Constitution itself," writes Bardhi./ CNA
