The Parliamentary Group of the Democratic Party addressed a letter to the Assembly, regarding the sentence of MP Ervin Salianji to one year in prison.

On behalf of the group, Gazment Bardhi asks Speaker Elisa Spiropali to urgently convene the Mandates Council.

Bardhi describes the decision of the Court of Appeal as an act of political revenge, while seeking to preserve Salianji's mandate.

"With an act of political revenge, the Court of Appeal of General Jurisdiction, with a decision dated September 26, 2024, has ordered the imprisonment of a member of the Parliament of Albania, an official of the opposition, colleague Ervin Salianji, for an uncommitted crime and for a case fabricated by certain segments of the State Police and the Prosecutor's Office. This political act, which violates the foundations of the democratic state, affects the integrity of the Parliament of Albania and violates the mandate of an opposition deputy," the request states, among other things.

With an act of political revenge, the Court of Appeal of General Jurisdiction, with a decision dated September 26, 2024, ordered the imprisonment of a member of the Parliament of Albania, an official of the opposition, colleague Ervin Salianji, for an uncommitted crime and for a cases fabricated by certain segments of the State Police and the Prosecutor's Office. This political act, which violates the foundations of the democratic state, affects the integrity of the Assembly of Albania and violates the mandate of an opposition deputy.

Yes, in an extra legal procedure, without the authorization of the Assembly, with an inexplicable haste, the Prosecutor's Office is following the procedure for the arrest of the opposition deputy. According to Article 73, point 2, "The Member of Parliament cannot be arrested or deprived of his freedom in any form, or subject to a personal or home search, without the AUTHORIZATION of the Assembly".

These actions of the justice bodies, which violate the basic principles of the rule of law, have created an alarming situation of political attack on the opposition. The punishment without law and proof of the opposition deputies, disregarding the authority of the Assembly of Albania, flagrantly violating the Constitution of the Republic of Albania, not justifying the repressive measures against the opposition deputies, is an unprecedented act in a democratic state.

For this reason, in accordance with Article 73, point 2 of the Constitution, and Article 13 of the Regulation, we request the urgent meeting of the Council for Regulation, Mandates and Immunity, to restore the authority of the Assembly of Albania, the restraint of political acts against the members of the Assembly of Albania, and the restoration of constitutionality"./ CNA
