In the Special Court of First Instance for Corruption and Organized Crime in Tirana, the trial continues in connection with criminal proceedings no. 40 of 2022 registered in the Special Prosecution Against Corruption and Organized Crime in charge of the defendants: Selaudin Shahini, Ndriçim Shahini, Ervis Cara, Endi Ahmetaj, Vojsava Doda, Aurel Shatri and Fatri Braha.

In the court session dated 18.04.2023, the Special Prosecutor's Office against Corruption and Organized Crime presented the final conclusions, requesting among others:

1. The guilty plea of ??the defendant Selaudin Shahini for committing the criminal offenses of "Trafficking of motor vehicles", committed more than once and in cooperation in the special form of cooperation, that of a structured criminal group and "Committing the offenses criminal organization and structured criminal group" and "Structured criminal group", in the form of the leader of the structured criminal group, provided by articles 141/a/2, 28/4, 333/a/1, 334/1 and 50/a of the Criminal Code, as well as based on these articles, as well as article 55 of the Criminal Code in the combination of punishments, his sentence is 12 (twelve) years of imprisonment. Based on article 406 of the Criminal Procedure Code, for due to the shortened trial, the final punishment of the defendant Selaudin Shahini with 8 (eight) years of imprisonment has been requested.

2. The guilty plea of ??the defendant Ndriçim Shahini for committing the criminal offense of "Trafficking of motor vehicles", committed more than once and in cooperation in the special form of cooperation, that of the structured criminal group, "Committing the offenses criminal organization and structured criminal group" and "Structured criminal group", provided by articles 141/a/2, 28/4, 334/1, 333/a/2 and 50/a of the Criminal Code, as and on the basis of these articles, as well as article 55 of the Penal Code in combination of punishments, his punishment with 11 (eleven) years of imprisonment.

Based on Article 406 of the Code of Criminal Procedure, due to the summary trial, the final punishment of the defendant Ndriçim Shahini with 7 (seven) years and 4 (four) months of imprisonment has been requested.

3. The guilty declaration of the defendant Ervis Cara for committing the criminal offense of "Trafficking of motor vehicles", committed more than once and in cooperation in the special form of cooperation, that of the structured criminal group, "Committing the offenses criminal organization and structured criminal group" and "Structured criminal group", provided by articles 141/a/2, 28/4, 334/1, 333/a/2 and 50/a of the Criminal Code, as and on the basis of these articles, as well as article 55 of the Penal Code in combination of punishments, his punishment with 10 (ten) years of imprisonment.

Based on Article 406 of the Code of Criminal Procedure, due to the summary trial, the final punishment of the defendant Ervis Cara with 6 (six) years and 8 (eight) months of imprisonment has been requested.

4. The guilty plea of ??the defendant Endi Ahmetaj for committing the criminal offense of "Trafficking of motor vehicles", committed more than once and in cooperation in the special form of cooperation, that of the structured criminal group, "Committing the offenses criminal organization and structured criminal group" and "Structured criminal group", provided by articles 141/a/2, 28/4, 334/1, 333/a/2 and 50/a of the Criminal Code, as and on the basis of these articles, as well as article 55 of the Penal Code in combination of punishments, his punishment with 10 (ten) years of imprisonment.

Based on Article 406 of the Code of Criminal Procedure, due to the shortened trial, the final punishment of the defendant Endi Ahmetaj with 6 (six) years and 8 (eight) months of imprisonment has been requested.

5. The guilty plea of ??the defendant Vojsava Doda for committing the criminal offenses of "Trafficking of motor vehicles", carried out in cooperation in the special form of cooperation, that of the structured criminal group, "Commitment of criminal offenses by the criminal organization and the group structured criminal" and "Structured criminal group", provided by articles 141/a/2, 28/4, 334/1, 333/a/2 and 50/a of the Criminal Code, as well as based on these articles , as well as Article 55 of the Penal Code in the combination of punishments, her punishment with 9 (nine) years of imprisonment.

Based on Article 406 of the Code of Criminal Procedure, due to the shortened trial, the final punishment of the defendant Vojsava Doda with 6 (six) years of imprisonment has been requested.

6. The guilty plea of ??the defendant Aurel Shatri for the commission of the criminal offense "Trafficking of motor vehicles", carried out in cooperation in the special form of cooperation, that of the structured criminal group, "Commitment of criminal offenses by the criminal organization and the group of structured criminal" and "Structured criminal group", provided by articles 141/a/2, 28/4, 334/1, 333/a/2 and 50/a of the Criminal Code, as well as based on these articles, as and Article 55 of the Penal Code in the combination of punishments, his punishment with 8 (eight) years of imprisonment.

Based on Article 406 of the Code of Criminal Procedure, due to the shortened trial, the final punishment of the defendant Aurel Shatri with 5 (five) years and 4 (four) months of imprisonment has been requested.

7. The guilty declaration of the defendant Fatri Braha for committing the criminal offense of "Abuse of duty", provided by article 248 of the Criminal Code, as well as based on this article, as well as article 50 letter "a" of the Criminal Code, the punishment his with 1 (one) year and 6 (six) months imprisonment.

Based on Article 406 of the Code of Criminal Procedure, due to the shortened trial, the final punishment of the defendant Fatri Braha with 1 (one) year of imprisonment has been requested.

8. In relation to serving the prison sentence for the defendants Selaudin Shahini, Ndriçim Shahini, Ervis Cara, Endi Ahmetaj, Vojsava Doda and Aurel Shatri, it has been requested that it be carried out in a high security prison.

9. Regarding the serving of the prison sentence for the defendant Fatri Braha, it has been requested that it be carried out in a regular security prison.

10. The confiscation of a Mercedes-Benz car, a neck pendant with a thick chain made of serm material, a wristwatch with a Rolex brand chain, 5820 allek, 800 euros and 6 mobile phones of different brands and types have also been requested.

The defendants have been sent for trial due to the fact that the structured criminal group led by the defendant Selaudin Shahini, which included the defendants Ndriçim Shahini, Ervis Cara, Endi Ahmetaj, Vojsava Doda, and Aurel Shatri, as well as persons others still unidentified, during the month of February 2022 secured stolen vehicles in the Republic of Kosovo and then smuggled them into the territory of the Republic of Albania from the border crossing point Morina, Kukës with license plates placed on them, which belonged to the registered vehicles and registered in the Republic of Albania.

At the time of the commission of the criminal offense, the defendant Endi Ahmetaj was a police officer in the "Shqiponja" special force, in the Order and Community Policing Sector in the Kukës Local Police Directorate, while the defendant Vojsava Doda was an inspector. police at the Directorate of the Special Operational Force in the General Directorate of the Tirana State Police.

The defendant Fatri Braha, at the time of committing the criminal offense of "Abuse of duty" was a police officer with the rank of inspector in the Local Directorate of Border and Migration Kukas, as well as on 24.02.2022, having the duty of "Assistant specialist controller" ", at the Morin Border Police Station, Kukës, deliberately did not perform the verification and registration procedures in the TIMS System for the defendant Vojsava Doda, creating facilities for her to traffic a stolen vehicle in the Republic of Kosovo, a vehicle which entered the territory of the Republic of Albania with the license plates of another vehicle registered in Albania, and was driven by this defendant.

The criminal activity of the defendants was discovered on 24.02.2022, and the defendants were arrested in flagrante delicto or detained on 25.02.2022.

By the Special Court of First Instance for Corruption and Organized Crime, the court session has been postponed until April 28, 2023 for the delivery of the final conclusions by the defendants and their defenders.
