The Special Court of Appeals for Corruption and Organized Crime has upheld the first instance decision on the imprisonment of Fatbardh Hoti (also known as Bardh Hoti, Fatbardh Daci, Bardh Daci).

He was convicted of the criminal offenses of "Theft"; "Embezzlement of money or goods deriving from a criminal offense or criminal activity", offenses committed in collaboration in the form of a structured criminal group.

In the end, the Appeal left Hotin in prison. He was finally sentenced to 7 years and 4 months in prison.

Komunikohet në mënyrë të përmbledhur se, sot më datë 27.06.2022, në Gjykatën e Posaçme të Apelit për Korrupsionin dhe Krimin e Organizuar, u shpall vendimi lidhur me çështjen me nr. 38 akti, datë 04.04.2022 regjistrimi, në ngarkim të të pandehurit B.H. (alias F.H., alias F.D., alias B.D.), ku trupi gjykues i Gjykatës së Posaçme të Apelit për Korrupsionin dhe Krimin e Organizuar, i përbërë nga gjyqtarët Miliana Muça, Engert Pëllumbi dhe Igerta Hysi, vendosi:

Lënien në fuqi të vendimit nr.10 datë 11.02.2022 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar lidhur me faktin penal, cilësimin juridik të faktit penal, masën e dënimit të të pandehurit H. (F.H., F.D. ose B.D.) për veprat: “Vjedhja”; “Përvetësimi i parave ose mallrave që rrjedhin nga vepra penale ose veprimtaria kriminale”, vepra të kryera në bashkëpunim në formën e grupit të strukturuar kriminal, të parashikuara përkatësisht nga nenet 134 paragrafi i tretë, dhe 287/b, në lidhje me nenet 28 pika 4 dhe 334 pika 1 të Kodit Penal, “Grupi i strukturuar kriminal” parashikuar nga neni 333/a paragrafi i dytë i Kodit Penal, si dhe llojin sigurisë së burgut dhe shpenzimeve proceduriale.

Amending the decision no. 10 dated 11.02.2022 of the Special Court of First Instance for Corruption and Organized Crime, for the rest as follows:

- The guilty declaration of the defendant BH (FH, FD or BD) for the criminal offense "Theft", more than once, committed in special cooperation in the form of a structured criminal group, provided by Article 134, second paragraph, in relation to and Articles 28/4 and 334/1 of the Criminal Code, and his sentence of 8 (eight) years and 6 (six) months imprisonment.

- In application of Article 55, first paragraph of the Criminal Code, in addition to the sentences, the sentence of the defendant BH (FH, FD or BD), with 11 (eleven) imprisonment.

Pursuant to Article 406/1 of the Criminal Code, the final sentence of the defendant BH (FH, FD or BD), with 7 (seven) years and 4 (four) months imprisonment./ CNA.al
