The Specialized Chambers of Kosovo have confirmed the release of Hysni Gucat, former head of the Organization of War Veterans of the Kosovo Liberation Army.

In the Special announcement, it is stated that Gucati has been released with some conditions that will remain in force during the remainder of the sentence.

"On October 12, 2023, the President of the Specialized Chambers of Kosovo (DHSK), judge Ekaterina Trendafilova, decided to modify the sentence of Mr. Enter Gucati for his release on or around October 18, 2023, with the conditions set forth in the decision. These conditions will be in effect during the remainder of the sentence handed down by the Court of Appeal Panel, specifically for the remainder of the sentence of four years and three months. In order to make the decision, the President consulted with the judges of the panels that gave the sentence as provided for in Article 51(2) of the Law on Specialized Chambers and the Office of the Specialized Prosecutor ("the Law"), took into account the factors of rule 196(3) of the Rules of Procedure and Evidence as well as held a session with Mr. Gucati", it is stated in the announcement of the Court.

In the justification of the release, it is stated that there were several factors that weighed in favor of modifying his sentence.

In the announcement issued to the media, it is said that the former head of the OVL of the KLA has expressed regret for the actions taken, for which he received punishment.

"The president took into account that although the criminal offenses for which Mr. Gucati was sentenced are undoubtedly severe, considering the rather negative effect of the disclosure of confidential information on (potential) witnesses, there were several factors that weighed in favor of modifying his sentence. It is worth noting that the President concluded that Mr. Gucatit had the opportunity to reflect on his actions during his detention in the DHSK detention facility and that his behavior had changed over time. The president emphasized the expressions of regret of Mr. Gucat, in particular, especially the apology, during the oral hearing, that he expressly asked for to all those who may have felt threatened by your actions. Also, the President pointed out the determined commitment of Mr. Gucati that he would not be involved in other actions that could be characterized as criminal offenses against the administration of justice and that he will fulfill all the conditions set for his release.
