KLSH finds that the debt to insurance reached 17 billion ALL during 2022

Debt towards social security is increasing rapidly from year to year even though the legal measures against these obligations are tough.

The High State Control, during an audit at the Social Insurance Institute, found that until the end of 2022, about 17,128,533 thousand lek of arrears belonging to more than 109,110 debtor entities have not been made available to the social insurance fund.

During the year 2022, there was a significant increase in the number of debtors of 5,482 entities, as well as an increase in arrears by ALL 1,261,797.

KLSH argues that the high number of entities with unpaid obligations contains risks in itself, since the unpaid obligations of the debtor entities in relation to the unpaid amounts of contributions represent a significant number of people employed in these entities, who cannot benefit from the social insurance scheme; 

KLSH urges that in order to administer the social security as well as possible, the collection of the obligations of the subjects for the social security should be done, given that the social security contributions are calculated, declared and paid within the 20th of the following month.

The total amount of ISS debtors turns out to be 14,354,079,374 ALL and together with interests and fines, the total amounts to 17,128,533,616 ALL, 58% of these debtors are legal entities and 38% small businesses. 

Based on Law no. 9136, "On the collection of mandatory social and health insurance contributions in the Republic of Albania", that "If the contributions are not paid on time, the relevant body has the right to take coercive measures" According to the law, the fiscal agent for the collection of contributions is taxes.

ISSH has handled analytically the situation related to the arrears of social security contributions, a significant figure in the number of debtors, and has addressed during 2022, the General Directorate of Taxes with letters with the object of the problems arising from the arrears in terms of social security contributions. 

In 2022, the situation of debtors continues to remain problematic, since compared to 2021, the number of debtors created by budgetary, non-budgetary entities, big business and employees themselves, who pour their contributions into the DPT, increased by beyond.

In relation to the collection of these obligations, ISSH, despite having the duty according to its statute, to collect income from the contributions of natural and legal persons, does not have full authority to act and take coercive measures since their management is carried out by DPT. / Monitor.al
