It is happening more and more often that some MPs, whenever they have to justify the use of the floor of the Assembly as a key to solving personal problems, or when they want to put pressure on institutions for personal problems, wear the mantle of the holder of sovereignty of the people.

This happened to MP Salianji, who believes that within the costume of the MP, on the one hand, he can call all the representatives of the state to account to him, and on the other hand, whenever the Court asks him, he leaves the country and is absent from the hearings. .

This abuse of the concept of the sovereignty of the people, even Salianji can be forgiven, because in the end Salianji gets a lawyer when he needs them!

But recently, MP Plarent Ndreca was added to this list of MPs. Plarent Ndreca, a lawyer until yesterday, suddenly caught a piece of sovereignty.

Deputy Ndreca, during the reporting session in the Law Commission of one of the justice bodies, referred to himself and justified the attack on the High Inspectorate of Justice, with the claim that he was the holder of the sovereignty of the people.

IN THE MODERN ORDER, the power of the sovereign people is exercised according to LAW. It is based on the consent of the PEOPLE (PEOPLE SOVEREIGNTY), who exercise it through the voting of their representatives.

In our system, the citizens (the people) elect the deputies, the mayor and other representatives, to whom they give the power to govern.

In this form, the people exercise their sovereignty.

The sovereignty of the people is exercised either through delegation, through the direct instrument of the referendum or through a series of legal instruments (e.g. legislative initiatives), which always lead to delegation, because if a law is not discussed by the Assembly, it cannot become effective .

But beware!

The law must be discussed by the Assembly! Not from Plarent Ndreca!

On the other hand, the will of the people does not end with delegation, due to the simple fact that in democracy - if the political expectations of the community are ignored - deputies can be replaced by others, chosen by the community based on their real needs and interests.

Popular sovereignty is not transferred to the elected (Plarent) nor is it suspended until the elected is replaced by others (Plarent) by the SOVEREIGN.

The representation that the Assembly receives from the Sovereign cannot and should not serve as a misleading concept, as it is being used by the Ndreca-Salianji category.

Representation does not mean that each elected person exercises the will of the people in a unitary manner.

Deputies are not representatives of the people, but are politically responsible to the people, as elected by the people during the exercise of the right to vote by the people.

If they were representatives of the people, then we would have to count the votes of each deputy and give each one as much sovereignty as is carried by the part of the people who voted for him individually.

The community, i.e. the people as a whole, is represented only through the Assembly whenever it meets to decide.

Sovereignty is exercised through the state, not through Ndreca or away from Salianji.

In what capacity does MP Ndreca believe that he is exercising the sovereignty that he passed on to that people?

Which people? 500 voters who voted for Ndreca? Plarent Ndreca today believes that he can make a fuss in the Assembly, because 500 Albanians have transferred individual sovereignty to him?

Or MP Salianji, who after putting the sovereign in his pocket, believes that he can act as a prosecutor with some others who, like him, (according to Salianji's logic), can claim that they also have a piece of sovereignty in their pockets!

Even Salianj, together with the sovereignty, the people also gave him the right to hide an entire power, that of the Judiciary.

But if Salianji wanted the sovereignty that the people gave him to hide you, or to put pressure on the Court, who is Plarent Ndreca putting pressure on?

The High Inspectorate of Justice is not a body that exercises direct decision-making, so it is easy to feel immune to Plarent Ndreca's attacks. What about the courts and the prosecution that make direct decisions, how immune can they be to Ndreca-type attacks?

Was today's behavior of MP Ndreca proof of what will happen if the Xhafaj resolution is approved in the Assembly?/ CNA
