SPAK notice:

The Special Prosecutor's Office against Corruption and Organized Crime has registered criminal proceedings No. 189, of 2023, for the criminal offenses "Abuse of duty", committed in collaboration, provided by articles 248 and 25, of the Criminal Code, "Forgery of documents", more than once, provided by article 186/2, of Criminal Code, and "Forgery of seals, stamps or forms", more than once, provided by article 190/2 of the Criminal Code.

After conducting investigative actions, at the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime with Decision No. 176, dated 28.03.2024, decided:

1. The acceptance of the request of the Special Prosecutor's Office against Corruption and Organized Crime, with no. 176 of the basic register, registration date 19.03.2024, with the parties and the object defined in the introductory part of the decision;

2. The assignment of the "preventive sequestration" asset insurance measure, provided by article 274 of the Code of Criminal Procedure, on the immovable property identified as "Property number 36/341, according to AMTP no. 9715 dated 07.02.1994, currently identified in mortgage certificates with no. 112, dated 16.04.2020, and no. 1116, dated 24.12.2013, which has been demarcated by the Himarë Municipality in area no. Property 36/35 with an area of ??5080 m2;

The investigators of the National Bureau of Investigation and the Judicial Police Officers of the State Police have taken measures to execute the order of the Special Prosecution dated 28.03.2024, issued on the basis of the above criminal decision taken by the Special Court of First Instance for Corruption and Organized Crime.

Following the previous announcements made by the Special Prosecutor's Office, (according to the link: https://spak.gov.al/njoftim-per-shtyp-date-23-03-2024-2/ ) from the preliminary investigation carried out in the framework of this criminal proceeding, it has been found that persons who already have the procedural status of citizens under investigation, have carried out with concrete actions the actual displacement on the ground of an area of ??agricultural land of 5,080 m2, superimposing it on another owned property of the state. The citizens under investigation have exceeded all the powers that the law recognizes, stating the existence of an overlap of immovable assets on the ground and then confirming a settlement plan, which does not correspond to the actual circumstances on the ground. This layout has served not only for the subsequent transactions between different entities but also for the development of the property, including the equipment with a construction permit for a tourist complex in the name of a commercial company, which will be built on this land area, but also over that of 5,512 m2 previously seized by the Special Prosecutor's Office. The entire area of ??agricultural land of 10,592 m2, which has been subjected to preventive seizure procedures in two stages, is in fact owned by the state and turns out to have been alienated and then developed by a private entity.
