International drug trafficking and assistance in illegal border crossing/ SPAK

The Special Prosecution Office against Corruption and Organized Crime completed the investigations and has sent to the Special Court of First Instance, criminal proceedings no. 177 of 2023, against 10 defendants:

Musa Gjikola, Sokol Masha, Jani (alias Ilir) Meçja, Akil Alushi, Selami Lushkaj, Klodjan Muça, Denis Harusha, Lorenzo Çadri, Ledri Lulashi, Arian Gjata, accused of the following criminal offenses:

Musa Gjikola and Jani (alias Ilir) Meçja, for committing the following criminal offenses:

"Trafficking in narcotics", committed in collaboration in the special form of collaboration, that of a structured criminal group and more than once, provided for by articles 283/a/2 and 28 point 4 of the Criminal Code, in connection with article 334/1 of the Criminal Code "Commitment of criminal offenses by a criminal organization or a structured criminal group",
"Structured criminal group", committed in the form of leadership, provided for by article 333/a/1 of the Criminal Code.
Sokol Masha and Akil Alushi, for committing the following criminal offenses:

“Assistance to illegal border crossing”, committed in cooperation in the form of a structured criminal group, provided for by articles 298/2 and 28 point 4 of the Criminal Code, in connection with article 334/1 of the Criminal Code, “Commitment of criminal offenses by a criminal organization or a structured criminal group”,
“Structured criminal group”, committed in the form of direction, provided for by article 333/a/1 of the Criminal Code.
Selami Lushkaj, Klodjan Muça, Denis Harusha and Lorenzo (alias Arbër) Çadri (alias Hysko, alias Isufi, alias Çela), for the commission of the following criminal offenses:

“Trafficking in narcotics”, committed in collaboration in the special form, that of a structured criminal group, provided for by articles 283/a/1, and 28 point 4 of the Criminal Code, in connection with article 334/1 of the Criminal Code “Commitment of criminal offenses by a criminal organization or a structured criminal group”,
“Structured criminal group”, committed in the form of leadership, provided for by article 333/a/1 of the Criminal Code.
Sokol Masha, for committing criminal offenses:

“Trafficking in narcotics”, committed in collaboration in the special form of collaboration of a structured criminal group, (one episode consumed according to Article 283/a and the other remained in attempt according to Article 283/a-22 of the Criminal Code), and more than once, provided for by Articles 283/a/2, (22) and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code “Commitment of criminal offenses by a criminal organization or a structured criminal group”,
“Structured criminal group”, committed in the form of participation, provided for by Article 333/a/2 of the Criminal Code.
Akil Alushi, Ledri Lulashi and Arian Gjata, for committing the following criminal offenses:

“Trafikim i lëndëve narkotike”, kryer në bashkëpunim në formën e veçantë, atë të grupit të strukturuar kriminal, parashikuar nga nenet 283/a/1 dhe 28 pika 4 të Kodit Penal, në lidhje me nenin 334/1 të Kodit Penal “Kryerje e veprave penale nga organizata kriminale ose grupi i strukturuar kriminal”,

“Grup i strukturuar kriminal”, kryer në formën e pjesëmarrjes parashikuar nga neni 333/a/2 i Kodit Penal.

Hetimet rreth këtij procedimi penal janë realizuar në bashkëpunim të ngushtë me autoritetet braziliane, ekuadoriane, franceze, holandeze, italiane dhe serbe, të drejtësisë, Byronë Kombëtare të Hetimit dhe me strukturat e hetimit me Policinë e Shtetit për ekzekutimin e masave të sigurimit personal.

Nga hetimet e kryera për interesa të këtij procedimi penal ka rezultuar e provuar se 10 të pandehurit: Musa Gjikola, Sokol Masha, Jani (alias Ilir) Meçja, Akil Alushi, Selami Lushkaj, Klodjan Muça, Denis Harusha, Lorenzo Çadri, Ledri Lulashi, Arian Gjata, në bashkëpunim me disa persona të dënuar nga autoritetet e huaja dhe me disa persona të paidentifikuar ende, kanë trafikuar sasi të konsiderueshme të lëndës narkotike nga vendet e Amerikës Latine, nga Shqipëria drejt vendeve të Bashkimit Europian, si dhe kanë ndihmuar kalimin e paligjshëm të kufirit, nga Shqipëria për në Itali të 55 shtetasve sirianë.

Nga aktet e administruara ka rezultuar se të pandehurit dhe bashkëpunëtorët e tyre kanë koordinuar me njëri-tjetrin në kryerjen e aktiviteteve të ndryshme kriminale edhe përmes komunikimeve në platformën e enkriptuar, “SkyEcc”, të cilat janë administruar nga autoritetet e drejtësisë franceze, në kuadër të ndihmës së ndërsjellët juridike në fushën penale.

Në përfundim të hetimeve është konkluduar se të pandehurit: Musa Gjikola, Jani (alias Ilir) Meçja, Selami Lushka, Klodjan Muça, Denis Harusha dhe Lorenzo (alias Arbër) Çadri (alias Hysko, alias Isufi, alias Çela), kanë pasur rolin e drejtuesit dhe financuesit në veprimtarinë e paligjshme kriminale në fushën e trafikimit të narkotikëve, ndërsa të pandehurit, Sokol Masha, Akil Alushi, Ledri Lulashi dhe Arian Gjata, kanë pasur rolin e pjesëmarrësve në këtë veprimtari të paligjshme.

Gjithashtu, ka rezultuar e provuar se të pandehurit, Sokol Masha dhe Akil Alushi, kanë drejtuar në dhënien ndihmë për kalim të paligjshëm të kufirit të shtetasve sirianë.

Si rezultat i kontrolleve të ushtruara në 8 episode që i përkasin viteve 2020 dhe 2021 (sipas akuzave që iu janë atribuuar respektivisht të pandehurve), rezulton e provuar se kanë trafikuar nga vendet e Amerikës Latine (Brazili, Ekuador) në drejtim të porteve kryesore të disa vendeve të Bashkimit Europian (Italisë, Holandës), apo nga Shqipëria për në drejtim të Greqisë dhe Gjermanisë, një sasi prej 4,340.2 kg lëndësh narkotike:

3635 kg of cocaine-type narcotics
2 kg of heroin-type narcotics
701 kg of cannabis sativa narcotics
In order to identify other accomplices of the defendants who participated in these episodes of drug trafficking, we have proceeded with the separation of criminal proceedings No. 177 of 2023, numbering as criminal proceedings with no. 177/2 of 2026, and investigations into this proceeding are continuing./ CN A
