While there are thousands of citizens who are unable to solve the problem of ownership of real estate, looking for a solution from the state, ironically the latter seems to be busy in the same "cycle".

A recent audit of the Supreme State Control (SSC) at the State Cadastre Agency (SCA) concluded that today there is no complete inventory of state and public assets, while the process of their registration is at extremely high levels low.

The auditors underline from the sector of state property transfer procedures, for central institutions and those dependent on them from 2003 to 2022, 82 VKM were approved, while 6 VKM were approved for independent institutions.

"At the central level, referring to the approved lists in the Republic of Albania, there are approximately 16,572 properties, of which 11,385 properties belong to Anonymous Companies, with state shareholders. In total, it results that out of 16,572 state properties approved through 88 VKM, only 1302 of them have been registered or 9%.

The reporting of figures related to state assets is done through the designation "property", but it should be noted that a property reflected in the inventory lists of state institutions may consist of several assets," the report states.

The reason for this situation seems to be the costs that accompany the procedure of registering a property. For each procedure at the Cadastre, you have to pay a fee, and this burden is considered unaffordable by the municipalities.

"The audit shows that the main obstacle in the registration of state assets by the municipalities is the registration fee. The transfer of properties by Decisions of the Council of Ministers has not been accompanied by financial assistance, through the inclusion of these funds in the unconditional fund or in the specific funds that municipalities receive for certain functions.

The new legal changes, specifically Law 20/2020, although it attaches special importance in Chapter IV to the updating, inventory, transfer and registration of state properties, in Article 43, provides that the registration fee for state institutions and local self-government units will reduced life.

However, this legal definition is not reflected in Decision no. 389, dated 13.5.2020 "On the approval of the list and fees of cadastral services", without determining in any provision how this differentiated treatment will be done through reduced fees and to what extent this fee will be," it is stated in the KLSH document.

In relation to this issue, it is recommended that the ASHK should first take measures to determine the reduced level of fees for the registration of state real estate, evaluating this level in cooperation with the Directorate of Local Finances in the Ministry of Finance. , in order that the payment of these fees does not create large costs for the modest budgets of the municipalities.

Secondly, in order to have a better follow-up of the process, it has been recommended that the department of state property transfer procedures in ASHK take measures to request from the municipalities the number of applications that have been made to the respective DVASHK for the registration of assets.
